1. The subject of the contract is: provision of hotel services for the needs of accommodation and meals for individual groups in Rzeszów during the III European Games Kraków-Małopolska 2023, divided into 3 parts of the contract.

2. A detailed description of the subject of the contract is included in Annex A to the SWZ and in the calculation table – price list (Annex 1.1 to the offer form), constituting a list of ordered services, in which the Contractor should include a detailed calculation of the offer price.

1. The subject of the contract is: provision of hotel services for the needs of accommodation and meals for individual groups in Rzeszów during the III European Games Kraków-Małopolska 2023,

2. A detailed description of the subject of the contract is included in Annex A to the SWZ and in the calculation table – price list (Annex 1.1 to the offer form), constituting a list of ordered services, in which the Contractor should include a detailed calculation of the offer price.

Part / task 1 - groups of Judges and members of the Organizing Committee

1.1. The Contracting Authority allows tenders to be submitted for individual lots of the contract and does not limit the number of lots for which a contract may be awarded to one Contractor.

2. General requirements:

2.1. The contractor must offer the subject of the contract in accordance with the description of the subject of the contract set out in Annex A to the SWZ;

2.2. Settlements between the Contractor and the Contracting Authority will take place partly on the basis of non-cash settlements – the Contractor must accept the date, method and rules of settlements referred to in the draft provisions of the contract (Annex 2 to the SWZ).

3. The Contracting Authority reserves the right of option pursuant to Article 441 of the Public Procurement Law to increase the scope of performance of the subject of the contract, i.e.:

a) Accommodation - increase the reservation of accommodation services, including the extension of the period of stay of participants from 08.06.2023 - the total value of accommodation services allowed under the option right may not exceed 20% of the value of the basic contract,

b) Catering services - increasing the number of catering services and extending the period of their provision. The total value of catering services permitted under the option right may not exceed 20% of the value of the basic contract.

The contracting authority reserves the right of option, in whole or in part, specified inter alia in Article 441 of the PPL, i.e. to increase the scope of the subject of the contract. Part of the subject of the contract described in the SWZ and the option agreement concerns the possibility of ordering an increase in the benefits described above. The Contractor shall not be entitled to any claims for the Ordering Party's failure to exercise the option right, in whole or in part. The Ordering Party guarantees the execution of the basic order. The Contractor is entitled to remuneration for the actually implemented scope of the subject of the contract.

4.4. The Contracting Authority shall inform the Contractor about its intention to exercise the right of option by providing it with a written Notification(s) by 24 June 2023. The statement will specify the performance and the value of the services covered by the option right.

4.5. In the event that the Ordering Party does not exercise or exercises the right of option. The use and execution of the order covered by the option is the exclusive right of the Ordering Party.

4.6. Settlement for the executed subject of the contract covered by the option right shall take place at the prices offered by the Contractors in the price form.
