Whenever the documents of the proceedings indicate the trademark of the material, patent or origin, sources or specific process which characterise the products or services supplied by a particular Contractor and which could lead to the favouring or elimination of certain Contractors or products, the Contractor may, in accordance with Article 99(5) of the PPL, use the indicated or equivalent other material which meets the technical requirements of the indicated Contractor and has the performance characteristics as required. referred to in Article 101(1)(2) of the Act
