Description:
Delivery and implementation of IT/system software for the Pathomorphology Departments and Central Molecular Laboratory at the Lower Silesian Oncology Center, including installation, training, and maintenance services, funded by EU resources.

The subject of the order is the delivery and implementation of IT/system software for the Department of Pathomorphology I and II as well as the Central Molecular Laboratory, Laboratory for Testing HLA Tissue Compatibility Antigens at the Lower Silesian Oncology, Pulmonology, and Hematology Center, along with installation, parameterization, and configuration, as well as conducting training in the operation of the system and providing maintenance services and author supervision as part of the project titled: Purchase of equipment for the oncology-pulmonology-hematology hospital in Wrocław in the scope of AOS and one-day services – STAGE I” No FEDS.05.01-IZ.00-0003/24, financed from the funds of the European Funds for Lower Silesia 2021-2027. The order is financed from EU funds under the project titled: Purchase of equipment for the oncology-pulmonology-hematology hospital in Wrocław in the scope of AOS and one-day services – STAGE I” No FEDS.05.01-IZ.00-0003/24, financed from the funds of the European Funds for Lower Silesia 2021-2027 (partial funding). Project/program identification number: No FEDS.05.01-IZ.00-0003/24 3.2. A detailed description of the subject of the order, referred to in item 3.1., is included in appendix No. 1 to the SWZ - Description of the Subject of the Order (OPZ), in appendix No. 3 to the SWZ - Price sheet, and in appendix No. 7 to the SWZ - Draft contract. I. The procedure is conducted in the mode of an unrestricted tender. II. Open procedure. III. The contracting authority does not allow submission of partial offers. The subject order has not been divided into parts: Based on Article 91 section 1 of the Act of September 11, 2019 - Public Procurement Law (Journal of Laws of 2024, item 1320, as amended), the Contracting Authority informs that it has not divided the order into parts. This decision was made due to the integrated nature of the order and the need to ensure functional and technological coherence of the entire IT solution. The subject of the order constitutes a logical, functional, and technological whole, the effective implementation of which requires a unified project, service, and integration approach. Dividing the order into parts could: • jeopardize the integrity of the system and its compatibility with the existing HIS system - CGM, • make effective data transfer to the Electronic Medical Documentation (EDM) difficult or impossible, • increase the risk of integration errors and the dispersion of responsibility among different contractors, • prolong the time of order execution and increase its costs. In addition, the execution of the order by one contractor: 1. Ensures economic efficiency – allows for cost optimization, avoidance of duplication of administrative expenses, and simplification of supervision over the execution of the contract. 2. Allows for clear determination of responsibility – for quality, timeliness, and compliance with the execution of the contract. 3. Does not violate the principle of fair competition – the contracting authority has not identified any grounds indicating that dividing the order would bring benefits in the form of increased competition or facilitate access to the order for smaller contractors. The order concerns a system that must operate as a uniform IT platform covering various organizational units, such as the Pathomorphology Department or Laboratories. Therefore, not dividing the order into parts is justified and in accordance with applicable legal provisions. IV. Market consultations were not conducted. V. Planned order. 6. Information about the reservation of the possibility of applying for the award of the contract exclusively by contractors referred to in Article 94 of the Pzp Act. - The contracting authority does not anticipate reservations in this regard. 7. Requirements regarding options - The contracting authority does not anticipate the possibility of utilizing options. The contracting authority does not anticipate settlements in foreign currencies. VII. The contracting authority reserves, pursuant to Article 139, section 1 of the Act, the right to first evaluate the offers, and then check whether the contractor whose offer has been evaluated as the most advantageous is not subject to exclusion and meets the participation conditions in the procedure. VIII. Item 9. SWZ - Requirements regarding the bid bond - The contractor is obliged to secure their offer with a bid bond in the amount of: 20,000.00 PLN (in words: twenty thousand Polish zlotys). A detailed description of the subject of the order referred to in point 3.1. is contained in appendix No. 1 to the SWZ - Description of the Subject of the Order (OPZ), appendix No. 3 - Price Sheet, appendix No. 7 to the SWZ - Draft contract. 6.1. In order to preliminarily confirm the lack of grounds for exclusion from the proceedings and the fulfillment of the conditions for participation in the proceedings, based on Article 125 sections 1 and 2 of the Pzp law, the contractor submits together with the offer affixed with a qualified electronic signature the following documents: 1. Completed and signed by persons authorized to represent the contractor: OPZ - appendix No. 1 to SWZ, Price sheet - appendix No. 3 to the SWZ, offer form - appendix No. 2 to the SWZ. 2. Current on the day of submitting the offers declaration in the form of a single procurement document (hereinafter: JEDZ) declaration in the form of the European Single Procurement Document (hereinafter as JEDZ/single document), prepared, under pain of nullity, in electronic form and marked with a qualified electronic signature – appendix No. 4 to the SWZ. 3. Declarations of the contractor/contractors jointly applying for the award of the contract regarding grounds for exclusion from Article 5k of Regulation 833/2014 and Article 7 sections 1 of the Act on special solutions concerning counteracting support for aggression against Ukraine and serving to protect national security – sample declaration is provided - appendix No. 4a to the SWZ. 4. Declarations of the entity providing resources regarding the grounds for exclusion from Article 5k of Regulation 833/2014 and Article 7 section 1 of the Act on special solutions concerning counteracting support for aggression against Ukraine and serving to protect national security - appendix No. 4b to the SWZ. 5. If the contractor relies on the capabilities or situation of entities providing resources, they must submit along with the declaration referred to in point 2, also declarations from the entity providing resources (appendix No. 4b to the SWZ), confirming the absence of grounds for exclusion of that entity and respectively fulfillment of the conditions for participation in the proceedings. The template of the commitment of the entity providing resources to provide the contractor with necessary resources for the execution of the order (if applicable) is provided in appendix No. 8 to the SWZ. 6. In the case of contractors jointly applying for the award of the contract, the declarations referred to in points 2 and 3 are submitted by each contractor. These declarations confirm the absence of grounds for exclusion and the fulfillment of participation conditions, to the extent that each contractor demonstrates compliance with the conditions for participation in the proceedings – the sample declaration is provided in Appendix No. 9 to the SWZ. 7. Completed and signed by persons authorized to represent the contractor Offer Form (in accordance with the document defining the legal status of the contractor or the power of attorney attached to the offer) appendix No. 4 to the SWZ. 8. The original power of attorney or a copy certified as compliant with the original by the issuing person or by a notary public, if the person signing the offer is not the person authorized based on the document defining the legal status of the contractor. For this power of attorney, according to Article 1 section 1 point 2 of the Act of November 16, 2006 on the stamp duty (i.e. Journal of Laws 2015, item 783 as amended), no fee is required. The power of attorney to submit the offer must be submitted in the original in the same form as the submitted offer (i.e. in electronic form affixed with a qualified electronic signature). An electronic copy (scan) of the power of attorney previously drawn up in written form is also permissible, in the form of an electronic certification prepared in accordance with Article 97 § 2 of the Act of February 14, 1991 – Law on Notaries, which certification a notary affixes with a qualified electronic signature, or by affixing the scan of the power of attorney previously drawn up in written form with a qualified electronic signature of the principal. An electronic copy of the power of attorney cannot be authenticated by the authorized person.
