The subject of the order is the execution of construction and executive design documentation for the task “Communicating A-4 with S-5 - construction of the Obornik Śląskie bypass”. Persons performing the above service will perform independent technical functions in construction.
Accordingly, and in order to preserve fair competition and equal treatment of Contractors, especially in the case of small Contractors, the Contracting Authority does not require employment by the Contractor or Subcontractor on the basis of an employment contract of persons carrying out the execution of the contract.
The project documentation should be prepared by the Contractor in accordance with Articles 99-103 of the Pzp Act.
A detailed description of the subject of the order shall be provided by the OPZ, which is the Annex to SWZ.

GENERAL INFORMATION
1. All design and cost estimates must be made according to
with applicable laws, including:
- Construction Law Act of 7 July 1994 (i.e. Journal of Laws of 2020 item 1333),
- Regulation of the Minister of Infrastructure on technical conditions, which should correspond to buildings and their location of 12 April 2002 (i.e. j Dz.U.
from 2019 item 1065),
- Regulation of the Minister of Transport, Construction and Maritime Economy on the detailed scope and form of the construction project of 25 April 2012 (Journal of Laws
from 2020 item 1609),
- Regulation of the Minister of Infrastructure on the detailed scope and form of design documentation, technical specifications for the performance and acceptance of construction works and the functional and utility programme of 10 May 2013 (Journal of Laws.
from 2013 item 1129),
- Regulation of the Minister of Infrastructure on the determination of methods and grounds for drawing up an investor cost, calculation of planned costs of project work and planned costs of construction works specified in the functional and utility programme of 18 May 2004 (Journal of Laws of 2004 No. 130 pos. 1389),
- Public Procurement Law Act of 11 September 2019 (i.e. Journal of Laws 2021 item 1129).
2. The Contractor shall be obliged to perform authorial supervision during the execution phase of works carried out on the basis of documentation constituting the subject of the contract from the date of conclusion of the contract with the Contractor of Works until the signing of the final receipt protocol of these works, on a separate order.
3. The Contractor will provide 6 pieces of documentation sets in paper form, together with all attachments, i.e. construction project, object of works and estimates, as well as prints signed by the designer, technical specifications of execution and acceptance of construction works, construction permit, project organization of the target movement, opinions, arrangements and approval of opinion institutions, i.e. Voivodship Conservator of Monuments, Lower Silesian Provincial Office, Starostwo District in Trzebnica and Municipal Office in Oborniki Śląskie and other necessary. All of the above documentation should also be provided in electronic version in the form of scans to PDF format, and cost estimates and works items additionally in ath format (NORMA) in the form of 4 CDs or DVDs.
4. Final receipt of the subject of the order must bear the necessary decisions and protocols.
5. The costs of obtaining all permits, certificates, surveying and other necessary studies shall remain on the Contractor's side.
6. The Contractor will provide for the executed works min. 36 months warranty.
7. Implementation of the task within 20 months from the date of signing the contract.
