The subject of the contract is the service of collection by the Contractor of waste with the code 19 12 12 from mechanical waste treatment installations, hereinafter referred to as ballast waste, in the amount of 2,000 Mg in order to manage them, in accordance with the decisions held by the Contractor. 1) Type of waste Waste is the residues from sorting of mixed municipal waste and separately collected fractions from plastic and paper, devoid of: a) sub-sieve fraction up to 80 mm constituting an input for the biological treatment of waste, b) plastic raw materials sorted using an optopneumatic device, c) waste from ferrous and non-ferrous scrap sorted with ferrous and non-ferrous metal separators, d) glass waste sorted manually in the pre-selection cabin, e) cardboard packaging sorted manually from fractions over 260 mm. 2) Method of order fulfilment: a) Ballast waste will be prepared by the Ordering Party in a loose form. b) Ballast waste collection will take place from the premises of the Waste Management Plant in Zakurzewo near Grudziądz. c) Waste collection will take place by vehicles at the disposal of the Contractor, at his expense, also in terms of transport costs, insurance for the time of transport and unloading; in accordance with the provisions of the Act of 14 December 2012 on waste (consolidated text: Journal of Laws of 2022, item 699, as amended), the Act of 20 June 1997. Road Traffic Law (consolidated text: Journal of Laws of 2022, item 988, as amended) and the Road Transport Act of 6 September 2001 (consolidated text: Journal of Laws of 2022, item 2201). d) Loading of waste on vehicles substituted by the Contractor shall be carried out by the Ordering Party using a VOLVO 110G or VOLVO 110H wheel loader, in a designated place at the Waste Management Plant in Zakurzewo near Grudziądz. e) The Contractor will collect waste on an ongoing basis, continuously, on all working days, i.e. from Monday to Friday, excluding holidays, from 7:00 to 14:00. f) During the performance of the contract, the Contractor is obliged to comply with the rules of traffic organization in force at the Waste Management Plant and to apply the recommendations of the Ordering Party's staff regarding waste loading. g) The maximum daily amount of waste to be collected by the Contractor is 50 Mg. h) The Ordering Party reserves that the amount of waste referred to above is an estimated amount and therefore may be reduced, provided that the Contracting entity guarantees the transfer of at least 1,000 Mg of ballast waste for collection and management. For failure by the Ordering Party to realize the estimated quantity in full, subject to the guaranteed quantity, the Contractor shall not be entitled to any claims. i) The waste collected by the Contractor will be weighed on a truck scale located on the premises of the Waste Management Plant in Zakurewo. To determine the weight of the waste collected, the Contractor's vehicle must also be weighed before entering the area indicated above. j) Upon transfer of waste by the Contracting entity to the Contractor, the Contractor shall assume responsibility for the seized waste, for its proper handling and the consequences resulting therefrom. k) The Contractor shall be solely liable for any damage, as well as for loss, shortages and damage to waste caused during transport and during unloading of waste, unless they arose solely for reasons attributable to the Ordering Party.
