Order. is implemented under the project "A comprehensive project of adaptation of forests and forestry to climate change - small retention and prevention of water erosion in lowlands".

The project is co-financed from funds from the European Community budget (Cohesion Fund) under the Operational Program Infrastructure and Environment 2014-2020)

Order subject is the performance of construction works in accordance with the technical documentation held by the Employer, technical specifications for the execution and acceptance of works (STWIOR), permits, contract and ToR, as well as preparation of as-built documentation, including geodetic documentation, for task VIII - Reconstruction of culverts for beards in order to protect road infrastructure in Zacisze and Rzeczyca forestry with the code given by the Center for the Coordination of Environmental Projects (CKPŚ): 11-24-2.1-01 planned for implementation by the Polanów Forest District.

Estimated order value also contains 50% of the orders referred to in art. 67 section 1 item 6 of the PZP.

The procedure is conducted in an open tender pursuant to art. 10 paragraph 1 and art. 39-46 of the Act of January 29, 2004. Public procurement law (consolidated text: Journal of Laws of 2019, item 1843 - hereinafter referred to as "PZP") and implementing acts issued on the basis of PZP regulations.

The procedure is conducted in accordance with the rules provided for contracts with a value equal to or higher than the amount specified in the provisions issued under Article 11 para. 8 PZP.

The proceedings are conducted in accordance with the rules provided for "Reverse procedure" referred to in Article 24aa section 1 and 2 PZP. Pursuant to the aforementioned provisions, the Employer will first evaluate the offers and then examine whether the contractor whose offer has been assessed as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure.

Map of the forest inspectorate constituting Annex No. 13 to the ToR, illustrates the location of individual objects. The detailed location has been described in the appendix to the ToR, project documentation prepared for individual facilities as part of task No. VIII constituting the attachment No. 2.

The subject of the contract has not been divided into tasks - this task is part of the entire undertaking and it is task No. VIII: Code according to CKPŚ 11-24-2.1-01

A detailed description of the contract is included in the design documentation attached to the ToR and Technical Specifications for the Performance and Acceptance of Works, prepared for task VIII constituting Annexes 2 and 3. Applicants should submit during the tender procedure all comments and reservations regarding the content of the ToR and project documentation by requesting their settlement by the Employer. The Contractor before submitting the subject of the contract for final acceptance is obliged to make an as-built geodetic map, technical acceptance and necessary tests, etc., and measurements by authorized units at his own cost. In addition, the contractor undertakes to submit approvals, technical approvals, and declarations of compliance for embedded materials, equipment and devices in accordance with the as-built inventory.

If the design documentation includes a reference to standards, European technical assessments, approvals, technical specifications and technical reference systems referred to in art. 30 paragraph 1 point 2 and par. 3 PZP, the contracting authority allows offering materials or equivalent solutions, provided that they ensure obtaining technical parameters not worse than specified in the above-mentioned documentation. The concept of equivalence should be understood that they will guarantee the performance of the contract in accordance with the description of the subject of the contract and ensure that technical parameters are not worse than those assumed in the abovementioned documents. In connection with the above, the Employer allows the possibility of offering products with other trademarks, patents or origin, but not with other properties and functionalities than those specified in the documentation. In accordance with art. 30 paragraph 5 PZP, the Contractor who refers to equivalent solutions described by the Employer is obliged to demonstrate that the supplies, services or works offered by him meet the requirements specified by the Employer.

In the case of offering solutions equivalent to those specified in the project documentation, the contractor is obliged to fulfill the requirement arising from art. 30 paragraph 5 PZP, i.e. obliged to demonstrate that the construction works offered by it meet the requirements specified by the contracting authority.

The contractor bears full responsibility for the organization and implementation of the construction process in such a way that the assumed objectives are achieved with the maximum possible minimization of damage to the forest environment. Designation of journeys and the area used for works must be agreed with the representative of the Employer. The contractor is responsible for the methods used in the performance of construction works and the final final result.
