Description:
The provision of public transport bus services in the area of operation of the Metropolitan Transport Board.

The subject of the sectoral contract shall be the provision of public transport bus services in the area of operation of the Contracting Authority, under the principles laid down in Annex No 7 to the SWZ — the draft provisions of the contract, also referred to as the “contract model”.

Part I: “Center D” segment

1. The subject of the sector contract is the provision of public bus services in the area indicated in Section II.2.3) of the notice (the main area in which the services will be provided).

2. The basic scope of operational work expressed in carriages (also referred to as “carriage”) to be commissioned by the Contracting Authority shall be:

Operational work [wozokm] broken down by type of rolling stock — basic range in the period: 01.10.2022 - 30.09.2030: MN - 2 605 856, BN - 19 468 110, CN - 0.

3. The Contracting Authority reserves the right to reduce the scope of the basic contract in each year of service performance (from 1 January to 31 December of the year concerned), in each type of rolling stock (MN, BN, CN), to a value of not less than guaranteed operational work in each year and the type of rolling stock which amounts to 85% of the operational work specified in point 2.

4. The dates for changes in the volume of operational work and the resulting change in the number of vehicles operating the Segment are set out in point 3.5. Specification of the Order Terms (SWZ).

5. The Contracting Authority shall be entitled to request the extension of the scope of the contract on the basis of the option referred to in Article 441 (1) of the Pzp Act, in the area covered by the contract, under the conditions specified in the model contract constituting Annex 7 to the SWZ.

6. The Contracting Authority requires that, from 1 October 2023, all vehicles be equipped with air conditioning of the passenger compartment which meets the requirements described in Annex 7 to the SWZ, in particular in Annex 1 to the model contract.

7. The Contracting Authority requires that, from 1 October 2023, all vehicles be equipped with a monitoring system complying with the requirements described in Annex 7 to the SWZ, in particular in Annex 1 to the model contract.

8. The Contracting Authority requires that, from 1 October 2023, all vehicles be equipped with USB chargers complying with the requirements described in Annex 7 to the SWZ, in particular in Annex 1 to the model contract.

9. The Contracting Authority requires that, from 1 October 2023, all vehicles be equipped with a device preventing the engine from starting an engine by a driver under the influence of alcohol that meets the requirements set out in Annex 7 to the SWZ, in particular in Annex 1 to the model contract.

10. The Contracting Authority requires that, from 1 October 2023, all vehicles be equipped with a Passenger Information System complying with the requirements described in Annex 7 to the SWZ, in particular in Annex 8a to the model contract. The deadlines for the introduction of selected functionalities are set out in Appendix No 8a to the contract model.

11. The Ordering Authority requires that, within 3 months from the date of conclusion of the Agreement, all vehicles carrying out the object of the order have the colours of the outer coat in yellow colour [RAL 1018].

12. Pursuant to Article 95 (1) of the Law of the PZP, the Ordering Authority requires employment by the Contractor or subcontractor on the basis of the employment relationship of drivers of vehicles, i.e. persons performing driving activities consisting in the performance of work

13. The method of verification of employment referred to in point 12 is described by the Contracting Authority in point 3.19 of the SWZ.

14. Pursuant to Article 91 (1) of the Polish Law, the Contracting Authority permits the submission of a tender by one Contractor for up to two parts of the contract.

Part II, Segment 'West C'

1. The subject of the sector contract is the provision of public bus services in the area indicated in Section II.2.3) of the notice (the main area in which the services will be provided).

2. The basic scope of operational work expressed in carriages (also referred to as “carriage”) to be commissioned by the Contracting Authority shall be:

Operational work [wozokm] broken down by type of rolling stock — basic range in the period: 01.10.2022 - 30.09.2030: MN - 3 907 569, BN - 5 053 989, CN - 755,808. Total 9 717 366 wozokm.

3. The Contracting Authority reserves the right to reduce the scope of the basic contract in each year of service performance (from 1 January to 31 December of the year concerned), in each type of rolling stock (MN, BN, CN), to a value of not less than guaranteed operational work in each year and the type of rolling stock which amounts to 85% of the operational work specified in point 2.

The Contracting Authority reserves the right to reduce the scope of the basic contract in each year of service performance (from 1 January to 31 December of the year concerned), in each type of rolling stock (MN, BN, CN), to a value of not less than guaranteed operational work in each year and the type of rolling stock which amounts to 85% of the operational work specified in point 2.
