Description:
The procurement involves purchasing various equipment for pathological diagnosis, divided into eight packages, to support the Pathology Laboratory under the National Oncology Strategy.

1. The subject of the order is: purchase of equipment for pathological diagnosis for the needs of the Pathology Laboratory, divided into 8 parts (hereinafter: part or package). The order includes the purchase of equipment for pathological diagnosis in 2025 under the National Oncology Strategy as part of the task entitled: “purchase of equipment for pathological diagnosis” in 2025.” - funding from the Ministry of Health.
2. A detailed description of the subject of the order is provided in the attachments:
1) Price form (separately for each package) – attachment no. 1.1 to the Terms of Reference,
2) Technical specification (separately for each package) – attachments no. 1.2.a - 1.2.h to the Terms of Reference,
3) Quality and service warranty conditions (separately for each package) – attachment no. 1.3 to the Terms of Reference,
4) Draft provisions of the contract – attachment no. 2 to the Terms of Reference.
3. The subject of the order is divided into 8 separate packages (parts), including:

4. The contracting authority allows the submission of bids for selected parts but does not allow the submission of bids for selected items within a given package.
5. Bids not containing the full scope of the subject of the order in a given package will be rejected.
NOTE:
The contracting authority requires the valuation of the unit of measure indicated in the price form. Changing the unit of measure is not allowed. The contracting authority draws attention to the fact that introducing additional columns by the contractor in the price form may lead to the lack of clarity of the bid or the calculation of the bid price in a manner different from the description provided by the contracting authority, and consequently – to the rejection of the offer.
6. The subject of the order must be allowed for circulation and use – in accordance with applicable laws, and must also have declarations of conformity (applies to all classes of medical devices) and certificates of conformity for the entire offered range issued by a notified body (applies to all classes of medical devices except class I) – applies to products registered as a medical device.
The contracting authority reserves the right to cancel the procurement procedure if public funds intended to finance all or part of the order are not granted to him, based on Article 257 of the Public Procurement Law. The contracting authority informs that, according to Article 139 of the Public Procurement Law, it will first examine and evaluate bids, and then qualify the contractor whose offer has been rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.
In fulfilling the obligation resulting from Article 24(6) of the Act of June 14, 2024, on the protection of whistleblowers, the contracting authority informs that at the Independent Public Healthcare Institution Voivodeship Specialist Hospital No. 3 in Rybnik an internal procedure for reporting information about breaches of law and taking subsequent actions has been adopted.
