The subject of the contract is the summer maintenance of streets, sidewalks, stairs and parking lots located in the Ursynów District m.st Warsaw in 2023.

1) The subject of the contract is the summer maintenance of streets, sidewalks, stairs and parking lots located in the Ursynów District m.st Warsaw in 2023.

Works related to the summer cleaning of streets, sidewalks, stairs and parking lots will be carried out at the request of the Ordering Party referred to in § 4 section 2 of the contract. The reported works called clearing of road lanes will consist in the implementation of:

• one wet mechanical cleaning of municipal roads and one manual cleaning of sidewalks, stairs and parking lots,

or

• one intervention action of wet mechanical cleaning of municipal roads

and one intervention action of manual cleaning of sidewalks, stairs and parking lots.

2) Obligations under the social clause

1. The contracting authority shall apply the social clause pursuant to Article 95 (1) of the Public Procurement Law Act.

2. The Contractor or Subcontractor shall be obliged to employ on the basis of an employment contract within the meaning of the Labour Code or the relevant provisions of the Member State of the European Union or the European Economic Area in which the Contractor or Subcontractor has its registered office or place of residence of employees who in the period indicated in § 2 will perform mechanical cleaning of roads and manual cleaning of sidewalks, stairs and parking lots.

3. The condition referred to in paragraph 2 shall be fulfilled by employing new employees on the basis of an employment contract or appointing already employed persons performing cleaning works consisting in mechanical cleaning of roads and manual cleaning of sidewalks, stairs and parking lots to perform the Agreement.

4. Detailed requirements for employment on the basis of an employment relationship, in the circumstances referred to in Article 95 of the Act, in particular the method of verifying the employment of persons under an employment contract, the rights of the Contracting Authority to control compliance by the Contractor with the above-mentioned requirements and sanctions for failure to meet them are specified in the draft provisions of the contract constituting Annex 5 to the SWZ.

A detailed description of the subject of the contract is specified in the Detailed description of performance and technical standards of the Subject of the Agreement constituting Annex 5a to the SWZ and at the same time Annex No. 2 to the Draft provisions of the contract and:

Draft provisions of the agreement constituting Annex 5 to the SWZ;

Price form constituting Annex 1 to the SWZ and at the same time Appendix No. 1 to the Draft provisions of the agreement;

List of streets and sidewalks intended for summer maintenance constituting Annex 5b to the SWZ and at the same time Annex No. 3 to the Proposed provisions of the agreement;

3) SIMILAR ORDERS:

The contracting authority provides for the possibility of awarding similar contracts referred to in

Article 214(1)(7) of the Public Procurement Law with a total value of up to PLN 200,000.00 net, consisting in: mechanical wet cleaning of streets and manual cleaning of sidewalks, stairs and parking lots. The contract will be awarded on condition that the Contracting Authority has the necessary financial resources and will be implemented on the basis of the basic agreement.
