The aim of the present procurement project is the award of a framework agreement on the provision of bicycles by way of leasing by means of deferred compensation for the employees of various municipalities and an institution under public law in the district of Leer over a period of six years between the clients as lessees on the one hand and an expert and efficient service provider together with a lessor as a financing partner on the other. Both the service provider and the lessor become joint contractors of the framework agreement. The framework agreement regulates the basic service relationships between the client and the contractor and contains the essential requirements for the individual leasing contracts as well as for the leasing and deferred compensation contracts for use by the employees. The individual leasing contracts as well as the leasing and deferred compensation agreements are concluded separately.
The clients are various municipalities and cities belonging to the district as well as an institution under public law in the district of Leer in Lower Saxony with a total of around 135,000 inhabitants. As local authorities within the meaning of § 2 (2) of the Lower Saxony Municipal Constitution Act (NKomVG), the clients are municipal employers and belong to the Municipal Employers' Association of Lower Saxony e.V., so that the total of around 1,600 employees of the clients are subject to the collective agreement for the public service ("TVöD"). With effect from 1 March 2021, this was supplemented by the collective agreement on deferred compensation for the purpose of leasing bicycles in the municipal public sector of 25 October 2020 ("TV bicycle leasing"). Against this background, the clients intend to implement TV bicycle leasing, which enables it to lease leaseable accessories from a company using these collective bargaining and tax reliefs, bicycles, e-bikes and cargo bikes within the meaning of § 63a StVZO ("bicycles") as well as after TV bicycle leasing and to make them available to employees for use. The subject of the procurement project is the award of a framework agreement between the contracting entities as lessees on the one hand and an expert and efficient service provider together with a lessor as a financing partner on the other hand, on the basis of which individual leasing contracts for the provision of bicycles and accessories for the employees
the client can be closed.
The main items of performance include:
(1) Introduction of the framework agreement into the administrative structures of the contracting entities, in particular through the availability of a (deputy) project manager and training of the personnel managers at the contracting entities;
(2) Implementation of the framework agreement and handling of the procedure for the provision of the bicycle through the operation of an online platform and the availability of contact persons for the persons responsible to the clients, for example in the case of questions regarding individual leasing contracts;
(3) Provision of bicycles and leased accessories (e.g. bicycle lock, lights, pedals, etc.) at the employee's choice on the basis of an individual leasing contract between a client as lessee and the contractor as lessor;
(4) marketing of bicycle leasing to employees;
(5) Provision of insurance benefits for defined insurance claims and handling of incident management as well as
(6) Services for the employees, such as annual maintenance and inspection services on the bicycles.
The contracting entities intend to conclude the framework agreement as a basis for the provision of services for a period of six years.
It can be assumed that a maximum of 1,600 individual leasing contracts will be concluded over the entire term of the framework agreement.
