Description:
Construction and equipment procurement for improving cardiological services in a hospital, requiring adherence to specific standards and consideration of ongoing medical activities.

1. The subject of the contract includes construction works under the 'design and build' formula for the investment task entitled 'Modernization of hospital infrastructure along with the purchase of equipment to improve accessibility, efficiency, and safety in the field of cardiological diagnosis and treatment'. 2. A detailed description of the subject of the contract is defined in the Functional-Utility Program (also referred to as 'PFU') - which constitutes Annex No. 2 to the Terms of Reference (SWZ). 3. The conditions for the execution of the subject of the contract are also contained in the Draft Provisions of the Agreement, which is Annex No. 7 to the SWZ. 4. The contractor will take into account the difficulties arising from carrying out work in an active facility and the need to maintain medical activity (clinics) in adjacent rooms. Due to the nature of the hospital's work – operating 7 days a week, 24 hours a day, the contractor will be able to carry out work basically without time restrictions. However, cumbersome works must be agreed upon each time with the person authorized by the Ordering Party, responsible for the current execution of the contract and for contacts between the Ordering Party and the Contractor. 5. The Ordering Party intends to co-finance the contract from state funds under the National Reconstruction and Resilience Plan: Component D 'Efficiency, accessibility, and quality of the health care system' Investment D1.1.1 'Development and modernization of high-specialized care center infrastructure and other healthcare entities'. 6. The Ordering Party reserves the right to annul this procurement procedure if public funds that the Ordering Party intended to allocate for financing all or part of the order have not been granted (Article 257 of the Public Procurement Law). 7. The Ordering Party did not divide the order into parts and does not allow for the submission of partial offers. The absence of the possibility of dividing the order results from the applied 'design and build' formula for the purposes of this investment. Additionally, the division of the order into parts is not justified due to: costs, work organization, and delivery time of the order. 8. The Ordering Party does not allow the submission of variant offers. 9. The subject of the contract must be performed in accordance with Polish Standards, with currently applicable regulations in this respect, including the Construction Law, health and safety (BHP) regulations, fire safety regulations, norms, knowledge, and construction art. The subject of the contract must be executed solely from new materials permitted for circulation and use in construction in Poland and the European Union. Materials must have technical approvals and necessary certifications, etc. 10. When calculating the tender price, which is a lump sum price not subject to indexation, all expenditures necessary to execute the subject matter described in the PFU must be taken into account. The contractor is obliged, based on the entire documentation of the proceedings, to independently make the relevant calculations for the purposes of the offer they intend to submit. 11. The trademarks, proprietary names, etc., specified in the documents are solely a quality, functional, technical, and technological standard concerning the subject of the order. In all cases where the specification of the subject of the order indicates the origin, names of materials, devices, or their origin, the use of equivalent materials, i.e., any materials or devices named in the documentation provided by the Ordering Party or their origin, is permissible. It serves solely to define the standard and can be replaced by others with no worse technical, utility, quality, functional, and aesthetic parameters, considering the proper interaction with other materials and devices. The names used in the order documentation that indicate or may be associated with a manufacturer or company do not aim to prefer solutions of a given manufacturer but indicate a solution that should have technical and technological characteristics no worse than those provided in the technical documentation. The Ordering Party will verify offers containing equivalent solutions regarding meeting the requirements of individual technical requirements contained in the annexes to the Specification. The contractor is obliged to prove in the offer the equivalence of the offered devices or systems. The burden of proving equivalence is the obligation of the contractor. The Ordering Party will not recognize equivalent solutions if they are of worse quality, functional, technical, and technological minimum requirements than those indicated in the annexes to the Specification. 12. The names of producers included in project documentation, technical specifications, or other documents (if they appear) are used for illustrative purposes only. The indicated names of products and their manufacturers do not aim to violate the principle of fair competition and equal treatment of contractors. Wherever they are indicated, they should be read with the phrase 'or equivalent' accompanying them. By the term 'or equivalent', the Ordering Party understands offering materials guaranteeing the execution of the task to achieve technical parameters no worse than those assumed in the above-mentioned documents. The use of equivalent solutions must not lead to degradation of the properties of the subject of the order compared to those provided in the technical documentation, nor to change the price, nor to violate legal provisions. 13. At the same time, requirements must be met in the areas of: 1.1. dimensions and construction (size, type, physical properties, and number of components); 1.2. functional characteristics (identity of function); 1.3. technical parameters (durability, resistance, technical data, structures); 1.4. user safety parameters; 1.5. emission standards. The above requirements constitute equivalency criteria. 14. The concept of equivalence also applies when the Ordering Party described the subject of the contract using standards, approvals, technical specifications, and reference systems.

Before preparing and submitting an offer, it is recommended that the contractor conducts a site visit of the future location where the subject of the order will be executed. The site visit will allow contractors to obtain information useful for preparing the offer, including familiarization with the technical condition of the existing facility. Conducting a site visit is not mandatory, but recommended due to the specificity of the subject of the order. The lack of a site visit does not result in the rejection of the offer based on Article 226 (1) (18) of the Public Procurement Law. The Ordering Party does not foresee verification by contractors of documents mentioned in Article 131 (2) of the Public Procurement Law. The site visit will take place on 30.10.2025 at 10:00 AM - Meeting at the main entrance to the main hospital building at Szpitalna 45 in Konin, ground floor.
