1) The subject of the contract is the liquidation of an ecological bomb on the site of the former Zakłady Tworzyw Sztucznych "Pronit" S.A. in Pionki.
2) The elimination of the environmental bomb consists in:
a) full extraction (removal), transport and transfer outside the premises of the former Pronit S.A. Plastics Plant in Pionki for the disposal or recovery of waste constituting a decommissioned explosive (nitrocellulose) in an estimated amount of up to 102Mg in terms of nitrocellulose.
b) disposal or recovery of waste previously extracted and transferred from the premises of the former Pronit Plastics Plant in Pionki constituting a decommissioned explosive (nitrocellulose) in an estimated amount of up to 102Mg in terms of nitrocellulose.
1) The subject of the contract is the liquidation of an ecological bomb on the site of the former Zakłady Tworzyw Sztucznych "Pronit" S.A. in Pionki.
2) The elimination of the environmental bomb consists in:
a) full extraction (removal), transport and transfer outside the premises of the former Pronit S.A. Plastics Plant in Pionki for the disposal or recovery of waste constituting a decommissioned explosive (nitrocellulose) in an estimated amount of up to 102Mg in terms of nitrocellulose.
b) disposal or recovery of waste previously extracted and transferred from the premises of the former Pronit Plastics Plant in Pionki constituting a decommissioned explosive (nitrocellulose) in an estimated amount of up to 102Mg in terms of nitrocellulose.
3) How to calculate the amount of nitrocellulose in the waste that is the end-of-life explosive (nitrocellulose) that is the subject of this contract:
a) based on the test results, the Ordering Party will calculate the arithmetic mean of the amount of nitrocellulose contained in the tested samples. The arithmetic mean of the amount of nitrocellulose thus determined shall be taken as the amount of nitrocellulose present in the entire transport batch. If in the tested samples the average amount of nitrocellulose is greater than the factor 0,7 (which should be understood as the ratio of the mass of nitrocellulose to the weight of the total waste), the calculation of the amount of nitrocellulose in the entire transport batch will be used to calculate the amount of nitrocellulose in the entire transport batch,
b) the amount of nitrocellulose calculated in the manner indicated in point a letter a above will be multiplied by the gross flat-rate unit price for 1 Mg of nitrocellulose, provided by the Contractor in its offer, which will give the Contractor a gross remuneration due for a given transport batch transferred outside the premises of the former "Pronit" S.A. Plastics Plant in Pionki and the waste disposed of or recovered as the subject of this contract,
c) the sum of gross remuneration calculated in the manner referred to in point b above, for all transport batches that will be transferred by the Contractor outside the area of the former "Pronit" S.A. Plastics Plant in Pionki and the disposed or recovered waste being the subject of this contract, will be the final total gross lump sum remuneration due to the Contractor for the performance of the entire subject of this contract.
(4) Conditions for the performance of works covered by the subject of the contract:
a) The Contractor and/or subcontractors will carry out the subject of the contract in accordance with the provisions applicable to the works covered by the subject of the contract together with the provisions in force in the field of fire protection, property supervision and occupational health and safety in this type of work,
b) The Contractor and/or subcontractors, if required by the performance of the subject of the contract, will be obliged to perform the subject of the contract in accordance with the provisions of the Construction Law, the principles of modern technical knowledge and the art of construction.
5) The contractor shall commission an authorized testing body selected by the contractor and independent of the contractor to test samples of the disposed of waste subject to this contract, in order to determine the amount of nitrocellulose contained in these samples. Samples will be taken from each transport unit prepared by the Contractor to transport the waste being the subject of this order, outside the premises of the former Zakłady Tworzyw Sztucznych "Pronit" S.A. in Pionki, from transport packaging randomly selected by the Ordering Party in the amount of 10% of transport packaging located in a given transport unit. Samples will be taken by the representative of the Contracting Authority and the Contractor.
