The subject of the order is to perform a service consisting of: performing active protection procedures consisting of one-time collection, spraying and expounding biomass (trees and/or shrubs) left over a total area of 7.5 hectares in the “Bielawa” Nature Reserve.
A detailed description of the subject matter of the contract is set out in Annex 7 to the SWZ and in the template of the contract, which is Annex 6 to the SWZ.
The offer must be made in Polish.
The offer shall be made, under the rigour of annulment, in electronic form.

The Contractor may withdraw the offer via the “Form to submit, modify, withdraw the offer or request” available on ePUAP and also made available on the MiniPortal.
1. The subject of the contract is the performance of a service consisting of: the implementation of active protection procedures consisting of one-time collection, spraying and exiting biomass (trees and/or shrubs) left in a total area of 7,5 hectares in the “Bielawa” nature reserve, with:
1. A detailed description of the subject matter of the contract is set out in Annex 7 to the SWZ and in the template of the contract, which is Annex 6 to the SWZ.
2) The item of the order was not divided into parts. The Contracting Authority shall not allow the submission of partial tenders referred to in Article 7 (15) of the Law Pzp.
The rationale for no division: The gathering, spraying and expounding of biomass within the “Bielawa” nature reserve is to be completed once in an area of 7.5 hectares. The breakdown of the contract in question into parts would threaten undue technical difficulties resulting from coordinating the activities of the various Contractors carrying out the individual elements of the contract and could seriously jeopardize the proper and timely execution of the contract. The scope of the work is described as a complete documentation from the point of view of the Ordering Party, considered and planned as a whole work for implementation by the Ordering Party. The services covered by the contract form a string of activities resulting from each other, technically coherent and constituting a single, indivisible whole. In addition, in the Contracting Authority's assessment, the failure to split the order into parts will not reduce competition to small and medium-sized
2. The Contracting Authority shall not reserve the possibility of applying for a contract only by the Contractors referred to in Article 94 of the Pzp Act.
3. Subcontracting:
1) The Contractor may entrust the execution of part of the contract to the subcontractor (subcontractor).
2) In connection with the execution of the contract, the contracting authority does not reserve the obligation to personally perform the key tasks of the contract.
3) The Contracting Authority requires that, if part of the contract is entrusted to subcontractors, the Contractor shall indicate in the offer the parts of the contract whose execution he intends to entrust to the subcontractors and provide (if they are already known) the names of those subcontractors.
4) Entrusting a part to subcontractors does not absolve the contractor from responsibility for the proper performance of the contract.
4. The Contracting Authority, acting on the basis of Article 95 (1) and (2) of the Act, informs that it requires employment by the Contractor and subcontractor on the basis of the contract of employment of persons performing the performance of the contract, consisting of the performance of the work in the manner laid down in Article 22 (1) of the Act of June 26, 1974 - Labor Code (i.e.: OJ 2020 item 1320 as amended).
1) Type of activities related to the execution of the contract which involve the employment requirements on the basis of the employment relationship by the Contractor or subcontractor of the persons performing the activities during the execution of the contract: work carried out manually: collection of biomass, its prism and elevation to potential export glazing
2) Method of verification of the employment of persons referred to in point 1: the statement of employment of the person or persons, which the Contractor shall communicate to the Contracting Authority within the time limit indicated in the call not less than 5 days.
3) Sanctions for failure to comply with the employment requirements on the basis of the employment relationship: notification of the competent labour inspectorate and requesting an inspection by it.
5. The Contracting Authority does not provide for the obligation of the contractor to perform a local vision.
