1. The Contracting Authority shall require the Contractors submitting the offer to lodge a bid bond before the deadline for submitting tenders in the amount of PLN 40,000.00 (forty thousand zlotys)
2. The Contractor is obliged to bring a defect on the deadline for the binding of the offer.
3. If the bid bond is not paid or the bid bond is not improperly lodged or the bid bond is not maintained continuously until the expiry of the deadline for binding the bid or submission of an application for the return of the bid bond in the case referred to in Article 98(2)(3) of the PPL, the Contractor's bid shall be rejected from the procurement procedure.
4. The tendering security may be lodged in one or more of the following forms:
1) money;
2) bank guarantees;
3) insurance guarantees;
4) sureties granted by entities referred to in Article 6b(5)(2) of the Act
of 9 November 2000 on the establishment of the Polish Agency for Enterprise Development (i.e. Journal of Laws of 2020, item 299, as amended).
5. In the case of a bid bond in the form of a guarantee or surety referred to in point 4 points 2 - 4 above, its content should result in an unconditional, irrevocable and at the first written request submitted by the Ordering Party (within the period of binding the offer) the Guarantor's obligation to pay the Ordering Party the full amount of the bid bond in the circumstances specified in Article 98 paragraph 6 of the PPL.
6. The bid bond lodged in the form of guarantees or sureties referred to in point 4 points 2-4 should be submitted to the Contracting Authority in the form of the original guarantee or surety, in electronic form and should be submitted to the Contracting Authority before the deadline for submitting tenders.
7. The bid bond paid in money shall be paid by the Contractor by bank transfer to the bank account of the Ordering Party - Bank PKO BP SA number 10 1020 5011 0000 9702 0169 6111:
1) the date and time of receipt of the funds on the Ordering Party's account shall determine the recognition by the Ordering Party that the deposit in money has been paid within the required period;
2) when placing a defect, the Contractor should specify the name of the object of the order and the case number.
8. The contracting authority shall return or retain the bid bond in accordance with the principles set out in Article 98 of the PPL
