The subject of the contract consists in the collection, transport and management of municipal waste from inhabited properties and real estate, which in part are real estate where residents live, and partly real estate where residents do not live (so-called mixed real estate) from the area of the Municipality of Ustka in the period of 12 months from 01.01.2024 to 31.12.2024.

1. The subject of the contract is the collection, transport and management of municipal waste from the area of the Ustka Municipality in 2024.

2. Description of the item of the order:

a) the subject of the contract consists in the collection, transport and management of municipal waste from inhabited properties and real estate, which in part is real estate where residents live, and partly real estate where residents do not live (so-called mixed real estate) from the area of the Municipality of Ustka;

b) the service covers the following types of municipal waste: unsegregated (mixed – residual) municipal waste, metals and plastics, glass, paper, biodegradable waste, furniture and bulky waste, waste electrical and electronic equipment, expired medicines (from points designated in pharmacies located in the city);

c) a detailed description of the subject matter of the contract is included in Appendix No. 11 to the Terms of Reference;

d) the estimated amount of municipal waste from property owners is indicated in the Price Form, constituting Appendix No. 2 to the Terms of Reference. The quantities of waste indicated in the Form are estimated quantities determined on the basis of the Contracting Authority's current knowledge of the projected amounts of municipal waste over a period of 12 months. The settlement will be made on the basis of the actual quantities of waste collected from the area of the City of Ustka Municipality from property owners in accordance with the rules set out in Appendix No. 4 to the Terms of Reference – model agreement;

e) a list of inhabited multi-unit properties and real estates which are partly real estate inhabited by residents and partly real estate not inhabited by residents is attached as Appendix No. 12 to the Terms of Reference;

f) a list of single-family inhabited properties and real estates which are partly real estate where residents live and partly real estate where residents do not live is attached as Appendix No. 13 to the Terms of Reference;

(g) the lists of immovable property are for information purposes only. When starting the service, the contractor must take into account the possibility of changing the number of individual properties.

3. Acting pursuant to Article 95 of the Public Procurement Law, the Contracting Authority requires the Contractor and Subcontractors to employ the following persons performing the following works as part of the performance of the subject matter of the contract:

(a) driving vehicles collecting and transporting waste,

(b) loading and unloading of waste.

They fall within the scope of Article 22 § 1 of the Labour Code, which reads: "By entering into an employment relationship, an employee undertakes to perform a specific type of work for the employer and under the direction of the employer and at a place and time designated by the employer, and the employer – to employ the employee for remuneration".

4. The method of documenting the employment of persons, the Contracting Authority's rights to control the Contractor's compliance with the above-mentioned requirements and sanctions for failure to meet these requirements are specified in Appendix No. 4 to the Terms of Reference – the contract template.
