1. The subject of the contract is the provision of disinfection, disinfestation, deratization (DDD) services in the facilities and official vehicles of the Provincial Police Headquarters in Łódź and its subordinate units – in the number and frequency consistent with the needs of the Ordering Party.
2. The contracting authority provides for a reverse procedure, in accordance with Article 139(1) of the PPL.
3. In view of the application of the procedure in Article 139 (1), the Contracting Authority shall not require the submission with the offer of the declaration referred to in Article 125 (1UPzp. The Contracting Authority will only request this statement from the contractor whose offer will be rated at the highest.
4. Pursuant to Article 257(1) of the Public Procurement Law, the Contracting Authority reserves the right to cancel the procedure if the public funds that the contracting authority intended to allocate to finance all or part of the contract are not granted to it.
1. The subject of the contract is the provision of disinfection, disinfestation, deratization (DDD) services in the facilities and official vehicles of the Provincial Police Headquarters in Łódź and its subordinate units – in the number and frequency consistent with the needs of the Ordering Party.
2. A detailed description of the subject of the contract (OPZ) is included in Annex 3 to the SWZ.
3. As part of the order, disinfection services also include (if there are such reports by users of facilities and/or company vehicles) disinfection of usable areas (counted on the floor in m²) and/or disinfection of company vehicles for 1 pc. vehicle, after contact with people suspected of being infected with COVID-19 or other infectious diseases.
4. A detailed list of facilities together with the estimated amounts of area and quantities of company vehicles for the provision of services is included in Annexes 2.2. - 2.4. to the SWZ – Price forms. They form the basis for calculating the price of the offer submitted in the present proceedings.
5. The DDD services in question will be provided according to the needs of the Ordering Party on its each order, in which the place and spaces designated by him (including single rooms) or the number of company vehicles will be strictly defined by him,
and in the case of smaller needs, they cannot constitute grounds for claims on the part of the Contractor.
6. The minimum value of the contract that the Ordering Party intends to perform shall not be less than 70% of the value specified in § 8 section 1 of Annex 12 to the SWZ – Model contract.
7. The Contractor is obliged to have, throughout the entire period of performance of the contract, civil liability insurance for business activity (contractual and tort liability) covering, at least, damage suffered by third parties, as well as representatives and employees of the Contracting Authority and the Contractor, as a result of death, bodily injury or health disorder (personal injury) or as a result of loss, damage or destruction of property (property damage), arising in connection with the performance of services covered by the contract for an amount not less than the amount of remuneration for the performance of the subject of the contract, referred to in § 8 section 1 of Annex 12 to SWZ – Model contract.
8. Pursuant to Article 95(1) of the Public Procurement Law, the Contractor/subcontractor undertakes that during the performance of the contract it will employ on the basis of an employment contract within the meaning of the provisions of the Act of 26.06.1974 – Labour Code (Journal of Laws of 2022, item 1510, as amended) or analogous regulations of EU and EEA Member States, all persons performing all activities related to the performance of disinfection services, disinfestation, deratization of premises in facilities and official vehicles. This requirement does not apply
in particular, natural persons conducting business activity to the extent that they will personally perform services for the Ordering Party.
