The subject of the framework agreement is the provision of postal services in accordance with § 5 PostG (in the version valid at the time of the award). This includes weekday collection, franking (taking into account the most cost-effective option), transport and delivery of letter items including postal delivery orders nationwide and internationally.
The service to be put out to tender comprises approximately the following volume per year (2022):

Actual quantities may vary in the future. The volume fluctuates over the course of a year and the Contractor must ensure that even quantities that deviate significantly from the annual average are properly collected, processed and delivered.
The letters are assigned to different cost centers. This must be taken into account when invoicing
a) Pick-up
The Contractor shall collect the addressed and enveloped mail from the Customer's mailroom on working days (Monday to Friday; except on public holidays).
Pick-up takes place from 3:30 p.m. to 4:00 p.m. at the earliest (a later time is possible after consultation with the client)
b) Postbehälter
All necessary mail containers and any transport trolleys are to be provided by the contractor without separate remuneration (cost-neutral), at any time in sufficient quantity and size adapted to the transported goods. The Contractor shall transport the postal items in weatherproof containers.
(c) Postage, carriage and delivery
Each outgoing consignment must be franked / cleared by the Contractor (taking into account the most cost-effective option)
The collected mail items of the client are to be delivered either by the customer himself or with the involvement of a third party (subcontractor, third-party entrepreneur).
In the case of delivery to the residential or business address stated in the address, the letter must be placed in the receiving device provided for this purpose or handed over to the recipient personally.
The contractor must ensure that the letter items are delivered no later than the third working day following the day of posting. This must also be complied with if the delivery to the PO Box is made by passing the shipment on to another shipping service provider. Reference is made to § 2 No. 3 PUDLV.
Unless otherwise stipulated for the individual types of consignment, the delivery area required by the Client includes the worldwide transport or delivery of all specified types of consignments to the recipients. It must not be subject to spatial restrictions, nor may there be grounds for exclusion from the transport or delivery of the consignments to the recipients that go beyond legal requirements.
(d) Consignments subject to verification
In the case of registered mail, the client will receive proof of posting of the consignment. The proof of posting is completed by the client and handed over to the contractor together with the registered letter. No later than the third working day (national) / the eighth working day (international) after handover, the client will receive the proof of posting back.
(e) Postzustellungsauftrag
The formal service of documents must be effected in accordance with §§ 177 et seq. of the German Code of Civil Procedure (ZPO) and the Bavarian Administrative Service and Enforcement Act (VwZVG), regardless of size and weight.
The Contractor must create a daily posting overview of the postal delivery orders handed over, which shows the number of postal delivery orders accepted. This posting overview is the basis for the monthly statement and is attached to the invoice.
f) Forms and labels
The Contractor shall provide the Contractor with the necessary labels and forms for posting lists, registered mail / acknowledgment of receipt, cash on delivery, postal delivery certificates, parcels, express shipments, etc. free of charge.
