2160/G23 - Lot 7 - Construction and operation of publicly accessible HPC fast charging infrastructure off the federal highways in urban, suburban and rural areas in the Federal Republic of Germany (Germany network - regional lots)

The object of this procurement procedure is the construction and operation of HPC charging infrastructure in public and semi-public areas for medium and long-distance transport.

The Confederation, represented by the Federal Ministry of Transport and Digital Infrastructure (BMVI), must ensure the provision of a nationwide and needs-based HPC charging infrastructure in accordance with § 3 paragraph 1 SchnellLG. As part of this procurement procedure, he selects contractors who will take over the construction, maintenance and operation of the HPC charging infrastructure in urban, suburban and rural areas in the Federal Republic of Germany (section 3 (5) SchnellLG).

The award is divided into 23 lots, whereby bidders can apply for all lots. The 23 lots are spread across 6 regions, so that one region includes 3-5 lots. For technical reasons of the Federal e-procurement platform to be used, this procurement procedure is published on a loose basis in such a way that the same procedures are created for each lot and its own announcements and announcement numbers are automatically generated for these lots. Nevertheless, all notices with reference number 2160/G23 are a single related procurement procedure.

This announcement concerns lot 7 - North-East region, lot 3 and covers areas of the federal states of Berlin, Brandenburg, Mecklenburg-Western Pomerania, Saxony and Saxony-Anhalt.

In particular, to safeguard future competition and security of supply and to avoid excessive demands on bidders, a bidder is limited (§ 30 paragraph 1 p. 2 VgV), according to which a bidder can be awarded only one lot per region and a maximum of three lots in total. This applies irrespective of whether he makes an offer alone, as a member of a community of bidders, as a subcontractor with a significant influence on the provision of services or in a combination of these possibilities; affiliated companies (§ 36 para. 2 GWB) are regarded as a unified company.

The Federal Government, represented by the Federal Ministry of Transport and Digital Infrastructure (BMVI), intends to establish and operate publicly accessible HPC charging infrastructure within the meaning of § 2 no. 9 charging stations ordinance in public and semi-public spaces for medium and long-distance transport in the lot mentioned under II.1.1) to forgive.

For this purpose, the client has defined the technical, economic and legal framework conditions in a contract. The service defined in this way is to be remunerated on a pro rata basis, whereby the specific amount of the remuneration is determined within the framework of this call for proposals - through a competitive procedure. In addition, the following points are particularly important in the context of service provision:

- The construction must take place within the construction deadlines in the search areas defined by the client in the respective location size (with four, eight, twelve or sixteen HPC charging points). The search areas are defined by the client in such a way that comparable existing charging infrastructure (from 150 kW) has been taken into account. In the course of construction, the bidder must acquire such land for the establishment of the site, which must meet the contractual requirements. Existing charging infrastructure can be incorporated under the conditions specified in the award documents.

- The user-friendly operation of the sites must be ensured with continuous availability of HPC charging facilities and a high level of service.

- Non-discriminatory access to HPC charging facilities must be ensured. This applies both to the so-called EMP (e-mobility provider) and directly to end customers when charging ad hoc.

- A flexible price cap for ad hoc charging is defined so that users can load at attractive prices.

This price cap is flexible and cost based and will be set in such a way that the future contractor remains an appropriate margin. Its flexibility follows the changing key cost items, such as variable electricity costs, procurement costs, as well as taxes, duties and allocations.

The amount of the flexible and cost-based price ceiling will initially be 44 ct/kWh including VAT, taking into account the current parameters and subject to negotiations leading in the procurement process. The abovementioned negotiations on the design of the price ceiling will be, in particular,

(1) that contractors will be able to generate additional revenue per kWh sold from next year through the GHG quota system; and

(2) how the different service prices can be adequately taken into account in connection with the procurement of electricity in connection with the provision of electricity.

It should also be noted that most of the service provision will only take place in 2023, when significantly more charging processes are expected per charging point due to the ramp-up of electric mobility.

- The non-discriminatory access fees that so-called EMP pay to the operator for their customers' charging processes must be market-standard and appropriate. They must also not exceed the price ceiling applicable to ad hoc charging. However, a price differentiation between the access fees for mobility providers and the fees for ad hoc charging is possible, insofar as this is objectively justified, in particular, by a lower processing effort of the service relationship with mobility providers.

- The aim of the invitation to tender is that the respective operator continues to operate the HPC charging infrastructure in a publicly accessible, non-discriminatory and user-friendly manner even after the contract with the Confederation has expired.
