The object of the order is the purchase of electricity for the facilities of the National Institute of Cardiology in Warsaw. The subject of the order includes: guaranteed scope of the order — purchase of electricity in the amount of 6,687, 475 MWh in the period from 01.01.2022r. to 31.12.2022r, scope of the optional order, in case of commissioning by the Ordering Party a reserved option right in accordance with the provisions of the contract - purchase electricity in the amount of 2,938,739 MWh in the period from 01.06.2022r. to 31.03.2023r.

1) The object of the order is the purchase of electricity for the facilities of the National Institute of Cardiology in Warsaw.

The subject of the contract includes:

1) the guaranteed scope of the order - the purchase of electricity in the amount of 6 687, 475 MWh in the period from 01.01.2022r. to 31.12.2022r. ;

2) the scope of the optional order (if the Ordering Party launches a reserved option right in accordance with the provisions of this contract) - the purchase of electricity in the amount of 2,938,739 MWh in the period from 01.06.2022r. to 31.03.2023r. ;

The electricity consumption determined by the Ordering Party is indicative. The quantities indicated are estimated quantities, determined to determine the value of the order. The Contracting Authority stipulates that it may purchase a greater or less amount of energy from the amount predicted.

A detailed list of electricity consumption for 6 energy consumption points shall be defined by the 'Price Form' constituting Annex 2 and No 3 to the SWZ.

The sale of electricity will be carried out through a distribution network owned by Innogy Stoen Operator Sp. z o.o. Nieświeska 52 Street, 03-867 Warsaw, managing Warsaw's electricity network - contract no. ND-D/250/2017 for the provision of electricity distribution services concluded for an indefinite period.

The Contracting Authority shall inform that he has a concluded contract for the purchase of electricity, valid until 31.12.2021. The procedure for changing the seller is carried out once again.

The Contracting Authority declares that it has legal title to use the facilities to which electricity is to be supplied. The list of objects shall be defined as “Description of the object of the order”, constituting Annex No 4 to the SWZ.

All measurement and billing systems in Bxx tariffs are tailored to the TPA principle.

2) A detailed description of the object of the contract, its scope, the requirements of the Contracting Authority and the rules for the execution of the order shall be

(a) Price form for guaranteed contract - Annex 2 to SWZ,

(b) Price form for optional procurement - Annex 3 to SWZ,

c) Description of the object of the order - Annex 4 to the SWZ,

(d) The designed provisions of the contract constituting Annex No 9 to the SWZ.

3. The Contractor is obliged to execute the order in accordance with applicable law and standards, in particular:

(a) by the Act of 10 April 1997, Energy Law (i.e. Journal of Laws of 2021, item 716, of late), and on the basis of the implementing provisions of that law, in particular the Regulation of the Minister of Economy of 04 May 2007 on the detailed conditions of the functioning of the system electricity (Journal of Laws of 2007 no. 93, item 623, as amended),

(b) the rules laid down in the concession;

(c) the provisions of the contract with the relevant Distribution System Operator (DSO);

(d) in accordance with consumer rights as defined by the Energy Regulatory Authority;

(e) in accordance with the provisions of the contract concluded with the Contracting Authority and in accordance with the offer made by the Contractor.
