2. Loan period: until 30.06.2040

3. Loan disbursement (disbursement) – one-time until 28.12.2023.

4. The Ordering Party reserves the right to use the loan at a time other than the one specified above, as well as to resign from disbursing all or part of the loan and expects that the bank will not charge any fees (except for the preparatory commission) on the values from which the Ordering Party has resigned.

5. Interest will be repaid on a monthly basis, on the last day of each month, in the amount appropriate to the credit used.

6. The Ordering Party reserves the right to early repayment of all or part of the loan. The bank will not charge a commission for early repayment of all or part of the loan.

7. The Ordering Party reserves the right to charge interest calculated until the date of repayment of the loan, and not until the end of the agreement, without a compensation commission, in the event of early repayment of the loan.

8. The Contracting Authority reserves the right to change the payment dates and the amount of capital installments during the loan repayment period, not exceeding 30.06.2040, depending on the financial condition of the municipality, with the mutual consent of the parties by way of an annex to the loan agreement.

9. A blank promissory note together with a promissory note countersigned by the Municipal Treasurer is a legal security for the repayment of the loan, as well as other receivables related to the loan. It is not allowed to sign as an additional security – Declaration of submission to enforcement based on Article 97 of the Banking Law Act of 29.08.1997.

10. In the case of joint bidding for the performance of a public contract (loan in a bank syndicate), the legal security for the repayment of the loan granted, as well as other receivables related to the loan, are blank promissory notes together with promissory note declarations, issued separately for the benefit of each of the Contractors, in the total amount up to the amount of the loan contracted. both promissory notes and promissory note declarations will be countersigned by the Treasurer of the Chmielnik Commune. It is not allowed to sign as an additional security – Declaration of submission to enforcement based on Article 97 of the Banking Law Act of 29.08.1997.

11. Grace period in repayment of the first installment of the loan until 30.05.2036

12. The first repayment of the principal instalment will take place on 31.05.2036.

13. The first interest payment will take place in the month in which the loan is disbursed.

14. The last repayment of the principal instalment and interest will take place on 30.06.2040.

15. Deadline for the use of the credit 31.12.2023
