The subject of the contract is to perform inspections, maintenance and servicing of fire-fighting installations and systems at the Silesian Museum in Katowice at ul. Tadeusza Dobrowolski 1 and al. Wojciecha Korfantego 3, in Katowice. The contract is being divided into three lots - A, B and C
1. Part A of the contract includes the inspection, maintenance and service of: SAP fire alarm systems (ul. T. Dobrowolskiego 1 and al. W. Korfantego 3, Katowice) and an audible warning system (DSO), early smoke detection system, detection system CO and LPG, smoke ventilation and fire ventilation systems, smoke protection systems, smoke exhaust system, FCP control system, smoke curtains, fire doors and gates (ul. T. Dobrowolskiego 1). A detailed description of the subject of the contract is included in Annex 2A of the ToR. The contractor is also required to perform the subject of the contract, in accordance with the model contract, which is Annex 3A of the ToR.
2. Deadline for completing the subject of the contract:
1) The Contractor is obliged to perform the basic contract from the date of the contract, but not earlier than from 01/04/2020 to 31/12/2020, subject to point 2) below.
2) The Awarding Entity provides for the option to apply the option right, which means that the Awarding Entity reserves the right to a one-time extension of the term of the contract. The above means that - if the Employer exercises the option right - the Contractor will also be obliged to perform the contract from 01/01/2021 to 31/12/2021.
3. Subcontracting
1) The contractor may entrust the execution of part (scope) of the subcontractor's contract. The subcontractor may not entrust the performance of the subject of the contract to further subcontractors without the written consent of the Employer and the Contractor.
2) The Employer requests that the Contractor indicate in the offer part (scope) of the contract, which he intends to entrust to subcontractors and, if known, a list of proposed subcontractors should be provided. In the event that the Contractor does not indicate in the offer the part (scope) of the contract which it intends to entrust to subcontractors, the Employer will assume that the Contractor will complete the contract itself.
3) The Employer requests that before proceeding to perform the contract, the Contractor, if they are already known, provide names or contact details of subcontractors and contact persons involved in the performance of the contract. The Contractor shall notify the Employer of any changes to the data referred to in the first sentence during the performance of the contract, and shall also provide information on new subcontractors to whom he intends to entrust the implementation of part (scope) of the contract at a later stage.
4) The Employer does not reserve the obligation for the Contractor to perform key parts of the contract in person, referred to in art. 36a section 2 item 1) of the PPL Act.

The Employer requires that the persons participating in the performance of the contract on the part of the Contractor during the period of performance of the Contract, i.e. the Representative and Technical Coordinators referred to in OPZ for Part A, were employed by the Contractor or subcontractor on the basis of an employment contract. The scope of activities of the above persons (or staff) as part of the implementation of the subject of the contract is specified in the content of OPZ. The method of documenting employment of staff is regulated by the provision in § 3 para. 24 of the model contract (Annex 3A of the ToR). The Employer's rights to control compliance by the Contractor with the abovementioned requirements and sanctions for their failure by the Contractor - are regulated by the provisions of § 3 para. 24 and 25, § 7 para. 1 point 10) and 11) and § 8 para. 1 item 6) of the model contract (Annex 3A of the ToR). The obligation to employ under an employment contract does not apply to a situation in which the Contractor, subcontractor personally performs the above activities (e.g. a natural person conducting business activity, partners of a civil law partnership).

A detailed description of the subject of the contract is included in Annex 2B of the ToR. The contractor is also required to perform the subject of the contract, in accordance with the model contract, which is attached as Annex 3B of the ToR.

A detailed description of the subject of the contract is included in Annex 2C of the ToR. The contractor is also required to perform the subject of the contract, in accordance with the model contract, which is Annex 3C of the ToR.

The scope of staff activities as part of the implementation of the subject of the contract is precisely defined in the content of OPZ. The method of documenting employment of staff is regulated by the provision in § 3 para. 20 of the model contract (Annex 3C to the ToR). The Employer's rights to control compliance by the Contractor with the abovementioned requirements and sanctions for their failure by the Contractor - are regulated by the provisions of § 3 para. 20 and 21, § 7 para. 1 point 9) and 10) and § 8 para. 1 item 6) of the model contract (Annex 3C of the ToR). The obligation to employ under an employment contract does not apply to a situation in which the Contractor, subcontractor or further subcontractor personally performs the above activities (e.g. a natural person conducting business activity, partners of a civil law partnership).
