Description:
High-quality supervision services are needed during the design, execution, and warranty periods of the electricity distribution infrastructure modernization project at the Port of Constanța to ensure compliance with contractual obligations.

The specific objectives of the contract are to provide high-quality supervision services, both during the Design and Execution Period of the Works, as well as during the Works Warranty Period, in order to monitor the correct use of the available funds and to ensure that the Contractor designs and executes the works according to the contractual obligations, especially concerning the duration, quantity, quality, and cost of the design and works. The Consultant will act as Supervisor according to the provisions of the Conditions of the Design and Execution Works Contract - "Modernization of the electricity distribution infrastructure in the Port of Constanța - Stage II" - of the General and Specific Conditions for Design and Execution Contracts approved by Government Decision no. 1 from January 2018. The service provider of the work supervision will provide the Beneficiary with a guarantee that the contractor to whom the Sectoral Works Contract was awarded will fulfill all the responsibilities assumed by signing it, will respect the legal provisions, technical regulations, and Specifications.
Number of days until clarifications can be requested before the deadline for submitting offers/candidacies: 18
The contractor will respond to requests for clarifications or additional information regarding the attribution documentation on the 11th day before the set deadline for the submission of offers.
Any request for clarifications must be sent in SEAP (https://e-licitatie.ro/pub).
Requests made after this deadline will not receive a response from the contracting authority.

In accordance with Specification no. 14235 from 04.04.2025.
Duration: 97 months (11 months design period + 25 months execution period + 1 month works closure period and acceptance at the completion of works + 60 months warranty period).

Continuation of GP information:
Method of establishing the participation guarantee: in accordance with Article 164 (2) and (4) of Law 99/2016.
The guarantee instrument must stipulate that the participation guarantee is irrevocable and that the payment of the participation guarantee will be executed unconditionally, upon the first request of the beneficiary, based on their declaration regarding the fault of the guaranteed person, without any exceptions.
In case of submitting offers in association, the participation guarantee must be established in the name of the association and mention that it covers all members of the group of economic operators jointly.
Situations of retention of the participation guarantee are provided by Article 43 of Government Decision 394/2016 and must all be mentioned in the guarantee instrument. The contracting authority reserves the right to hold the guarantee, according to Article 43 of Government Decision no. 394/2016.
The contracting authority may request the extension of the validity period of the offer. If the offeror extends the validity period of the offer, the validity period of the participation guarantee will be extended accordingly.
If the participation guarantee is established by bank transfer (payment order), the following account will be used:
- IBAN RO83BRDE140SV06373001400 opened at B.R.D.;
- IBAN RO26BTRL01401202693122XX opened at Banca Transilvania.
Proof of establishing the guarantee must be presented in SEAP (signed with the extended electronic signature of the legal representative/authorized person) no later than the date and time-limit for the submission of offers (the guarantee issued in another language will be accompanied by a certified translation into Romanian). The equivalence for a guarantee submitted in a currency other than LEI will be made at the average annual rate in lei/currency communicated by BNR.
In case of submitting offers in association, the participation guarantee must be established in the name of the association and mention that it covers all members of the group of economic operators jointly.
The non-presentation of the participation guarantee along with the offer results in the rejection of the offer as unacceptable under Article 143 (2) letter k) of Government Decision 394/2016, with subsequent amendments.
The participation guarantee is refunded under the conditions of Article 1641 of Law no. 99/2016, with subsequent amendments.
The participation guarantee issued in another language must be uploaded in SEAP, accompanied by the certified translation into Romanian, and subsequently, at the request of the contracting authority, must be presented in the original form issued in the country of residence.
In the situation where the Participation Guarantee is established through a Guarantee Policy or Bank Guarantee Letter, the offeror is obliged to send the original of the guarantee instrument within 5 (five) days from the deadline for submitting offers, to the headquarters of the contracting entity in Constanța city, Port Complex, Maritime Station, Constanța County, postal code 900900, to the attention of: Mirela Liliana MATEICIUC, procurement procedure responsible.

Instructions regarding the cancellation of the awarding procedure:
The contracting authority is obliged to cancel the application of the procedure for the award of the public/sectoral procurement contract, if it makes this decision, usually before the date of transmitting the communication regarding the result of the application of the awarding procedure and, in any case, before the date of signing the contract, only in the following cases:
- only unacceptable, inadmissible, and/or non-compliant offers have been submitted;
- no offer has been submitted, or offers have been submitted that, although they can be considered, cannot be compared due to the uneven approach to technical and/or financial solutions;
- serious violations of legal provisions affect the procurement procedure or it is impossible to conclude the contract.
In the sense of the provisions above, serious violations of legal provisions are understood to mean:
- the qualification and selection criteria, as well as the award criterion or the evaluation factors provided in the participation announcement, as well as in the awarding documentation have been modified, having the effect of restricting participation;
- during the analysis, evaluation and/or completion of the awarding procedure, errors or omissions are found, and the contracting authority is unable to take corrective measures without them leading to a violation of the principles.
By exception, the contracting authority has the right to cancel the application of the procedure for the award of the public/sectoral procurement contract, if it makes this decision, usually before the date of transmitting the communication regarding the result of the application of the awarding procedure and, in any case, before the date of signing the contract, only in the following cases:
- following the decision issued by the National Council for the Settlement of Complaints which orders the elimination of any technical, economic or financial specifications from the participation announcement, from the awarding documentation or from other documents issued in relation to the awarding procedure;
- the contracting authority no longer has the necessary funds to carry out the procurement or there is no longer any necessity to be covered; the two situations not being due to an action or inaction of the contracting authority.
The contracting authority is obliged to communicate in writing to all participants in the awarding procedure, within a maximum of 3 working days from the date of cancellation, both the cessation of obligations that they have created by submitting offers, and the specific reason that led to the cancellation decision.
