3. The proceedings are divided into two (2) independent tasks:

3.1. TASK I (Food Service) – the subject of the contract is the provision of services in the field of collection and management of post-consumer waste category 3 generated in the areas administered by the 41st School Aviation Base in Dęblin;

3.2. TASK II (Infrastructure) – the subject of the contract is the provision of a service

in the scope of collection, transport and management of grates and stabilized municipal sewage sludge from the mechanical and biological sewage treatment plant located in the Bezwola complex of the Wohyń commune;

2. TASK I (Food Service):

The Contracting Authority, acting pursuant to Article 95(1) of the PPL, requires the Contractor or subcontractor to employ persons to perform the contract on the basis of an employment contract throughout the entire period of performance of the contract, if the scope of activities of these persons consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2022. 1510): The Contractor or Subcontractor is obliged to employ persons driving vehicles used for waste disposal on the basis of an employment contract during the period of implementation of the subject of the contract.

In particular, the Contracting Authority requires employment on the basis of an employment contract of persons performing cyclical waste collection activities. The Ordering Party reserves the right to check the form of employment of persons performing the order. The requirement of employment under an employment contract is specified in detail in §17 of the proposed provisions of the contract constituting Annex 2b to the SWZ.

3.Polisa OC:

The selected Contractor with whom the Contracting Authority signs a public procurement contract must prove to have throughout the entire period of the contract civil liability insurance related to the subject of the contract, including also the liability of the insured for personal or property damage and caused by non-performance or improper performance of the contract during the insurance period, amounting to a guarantee sum of not less than PLN 100,000.00, together with proof confirming the payment of contributions of the above-mentioned value.

The selected Contractor must prove to have civil liability insurance for the amount indicated above at the latest on the day of signing the contract, under pain of terminating the calculation of the contractual penalty to the Contractor for which the contract is referred to in § 12 clause 1 point 6) of the contract.

4. The Contractor does not require the Contractor's personal performance of key parts of the order.

5. The contracting authority provides for the possibility of exercising the right of option specified in Article 441 of the PPL (in the case of task I).
