1. The subject of the contract is the supply of summer and winter diesel oil and heating oil.

2. The contracting authority shall allow partial tenders for the following tasks:

1) Task 1 involves the supply of 465,000 litres of summer and winter diesel fuel

2) task 2 involves the supply of 140 000 litres of fuel oil

3. Pursuant to Article 91 of the PPL, the contracting authority shall allow partial tenders to be submitted for one or all of the tasks referred to in point 2.

The subject of the contract within the scope of task No. 1 is the supply of 465 000 liters of summer and winter diesel fuel, including:

a) 450 000 liters to the Warehouse Team of the Repair and Operation Section of Rolling Stock Tłuszcz, 43 Przemysłowa Street, 05-240 Tłuszcz;

b) 15 000 liters to the Warehouse Team of the Rolling Stock Repair and Operation Section of the Warsaw Grochów Rolling Stock, 53 Chłopickiego Street, 04-275 Warsaw;

2. In all provisions of the SWZ and its annexes, which refer to standards, technical assessments, technical specifications and technical reference systems, in accordance with Article 101(4) of the PPL, the Contracting Authority shall allow the use of solutions equivalent to standards, technical assessments, technical specifications and technical reference systems indicated in the SWZ and annexes, if they allow to obtain features or parameters not worse than those referred to.

If equivalent solutions are applied, the Contractor shall prove in the tender, in particular by means of the evidence referred to in Articles 104-107 of the PPL, that the proposed solutions meet the requirements set out in the description of the subject of the contract to an equivalent degree.

3.If the Contractor does not submit the evidence in question or the evidence submitted is incomplete, the Contracting Authority shall call for their submission or supplementation within the prescribed period.

4. A detailed description, scope and manner of implementation of the subject of the contract respectively for a given task are specified in the Draft Agreement provisions constituting Annex 9 to the SWZ.

1. The subject of the contract within the scope of task No. 2 is the supply of 140 000 liters of fuel oil, including:

(a) 120 000 litres of fuel oil for:

Berestecka 15, 02-338 Warsaw;

Zespołu Magazynowego Tłuszcz, ul. Przemysłowa 43, 05-240 Tłuszcz;

Zespołu Magazynowego Sochaczew, ul. Osiedle Kolejowe 5, 96-500 Sochaczew;

b) 20 000 liters of fuel oil to the Maintenance Services Department, Grupa Utrzymania w Taj Taboru Tłuszcz, Przemysłowa 43, 05-240 Tłuszcz.

2.
