SPOT Monitors for Knappschaft Clinics

The subject of that invitation to tender is a framework agreement with several economic operators for the purchase of SPOT monitors, accessories, spare parts and consumables from Welch Allyn/Hillrom. Corresponding technology is already used in all Knappschaft clinics. It is estimated that around 125 more devices will be purchased. In order to make the profitability of the procurement comprehensible, a sales competition takes place.

The framework agreement shall include all tenderers who have submitted a complete tender and have fulfilled the selection criteria. For the execution of individual orders, a ranking is made according to the evaluation of the profitability of the tenders. To determine the profitability of the offers, 100% of the price is decisive. The individual orders are then placed according to the order of precedence. Deviations from the order of precedence are permitted if:

• due to price changes on the part of a contractor, a more economical order from another framework contract partner is possible

• a contractor is unable to meet the response time specified in an individual order or the required quality of task completion.

The prices in the price sheet are fixed prices and are valid for the entire term of the contract. The quantities given for this purpose reflect the estimated demand. In terms of accessories, spare parts and consumables, the demand may be higher. A minimum purchase or quantitative limit is not specified. The actual limitation results from the limitation of the bodies authorised to call. Billing is based on the quantities actually ordered after the award.

The contractor takes over sales and delivery. If necessary, the contractor shall carry out an initial briefing in this context. In principle, follow-up admissions (e.B. in the event of a change of personnel) are carried out by the hospital staff themselves. Any necessary maintenance and service work is not part of the tender. Billing and delivery addresses are specified by the respective customer when ordering. The billing and delivery addresses will be changed/supplemented by the contractor free of charge if necessary. The place of performance is at the respective customer or at the delivery address specified in the individual order. Delivery is free of charge.

If the manufacturer cancels an article without a successor model, the article is omitted. The contractor may offer successor articles. A successor article must at least meet the requirements for the precursor and must not be more expensive than the precursor in terms of price-performance ratio. For the purposes of the calculation, discount rates on the general list price of the manufacturer are queried for the articles queried in the price sheet. In the case of successor models, the contractor will grant an identical discount rate. In the case of new models, the parties will agree on which discount class the new model should be grouped under. If no agreement is reached, the new model will not become part of the contract. Changes in prices may in principle result in a change in the order of precedence among the framework contract partners.
