The subject of the contract is the successive supply of consumables for research at the Institute of Animal Reproduction and Food Research of the Polish Academy of Sciences in Olsztyn. A detailed description of the subject of the contract can be found in the offer form – Appendix No. 1 to the Terms of Reference. The Contracting Authority allowed the submission of partial offers (2 lots) in the procedure. Each Contractor may submit an offer for any number of parts

1. The subject of the contract is the successive supply of consumables for research at the Institute of Animal Reproduction and Food Research of the Polish Academy of Sciences in Olsztyn. A detailed description of the subject of the contract can be found in the offer form – Appendix No. 1 to the Terms of Reference. The Contracting Authority allowed the submission of partial offers (2 lots) in the procedure. Each Contractor may submit an offer for any number of parts

2. The offered laboratory materials and accessories must meet the requirements in terms of dimensions, type of material, additional parameters described in the offer form – Annex No. 1 to the SWZ. The offered laboratory materials must be approved for marketing in the Republic of Poland or the EU.

3. The contracting authority has established an option in accordance with Article 441(1) of the Public Procurement Law. The contractor will also include an option in the price of the offer. During the term of the contract, the Contracting Authority may use the option, but undertakes to perform the basic order in 50% of the value of specialist laboratory reagents indicated in the Contractor's offer. The Ordering Party reserves the right to change the quantity of the subject of the order specified in the offer form as well as to limit the subject of the contract. The right of option will be exercised on the terms set out in the draft provisions of the contract constituting Annex 3 to the SWZ. The condition for exercising the option right will be the submission by the Ordering Party of a declaration of will on the exercise of the option right.

4. The Contractor shall deliver the products together with the attached safety data sheets and/or quality specification containing basic data and physical and chemical requirements confirming the compliance of the delivered products with the RBS.

5. The term of the warranty granted for products may not be shorter than 75% of the term normally offered by the manufacturer, counting from the date of its delivery, in accordance with the date offered by the Contractor in the offer. The procedure for checking and confirming the conformity of the delivered order and the method of submitting complaints in accordance with the provisions of Annex 3 – the draft provisions of the contract.

6. The contract with the Contractor will be concluded for a period of 12 months. Partial delivery period: up to a maximum of 30 days from the date of placing the order by the Ordering Party.

7. The Contracting Authority requires the Contractor to submit the safety data sheets of the offered materials and/or a quality specification containing basic data as well as physical and chemical requirements along with the offer

confirming that the offered products meet all the requirements of the Ordering Party indicated in the description of the subject of the contract.

The executor shall file documents in the original or a copy certified for conformity with the original in electronic form bearing a qualified electronic signature. If the original of the document referred to above has not been produced in the form of an electronic document, the contractor may draw up and provide an electronic copy of the document in question. When the contractor transfers an electronic copy of the document, a qualified electronic signature shall be equivalent to certifying an electronic copy of the document for conformity with the original.

Documents drawn up in a foreign language should be submitted together with translation into Polish.

If the Contractor does not submit the above evidence measures in question or are incomplete, the Contracting Authority shall, in accordance with Article 107 (2) of the Pzp Act, call the Contractor within the specified time limit to submit or supplement them.
