1. The subject of the contract is the Supply of electricity for the needs of the Purchasing Group.
2. A detailed description of the subject of the contract (SOPZ) is included in Appendix 1A to the SWZ.
3. The Contractor must offer a subject of the contract that complies with the requirements of the contracting authority, specified in detail in the aforementioned appendix.
4. The forecast demand for electricity during the execution of the order is 56,656,543 kWh in the individual tariff groups indicated in Appendix No. 1A to the SWZ.

Supply of electricity for the needs of the Purchasing Group.
1. The subject of the contract is the Supply of electricity for the needs of the Purchasing Group.
2. The contracting authority informs that:
1) The Contractor is obliged to offer a unit price for individual tariffs;
2) The sale will take place through the distribution network belonging to the Distribution System Operator (OSD), i.e. from PGE Dystrybucja S.A., under the conditions specified in the regulations of the Act of April 10, 1997, Energy Law (consolidated text: Journal of Laws of 2024, item 266), hereinafter referred to as the “Energy Law,” in accordance with the applicable regulations to the aforementioned Act, the provisions of the Civil Code, the principles specified in the licenses, the provisions of the SWZ, and in accordance with the Energy price tariff presented in the tender offer, which the Contractor has an agreement with for the provision of distribution services in the areas where the electricity delivery point is located;
3) The partners and data concerning the contracts held by the partners are indicated in Appendix No. 1A to the SWZ.
4) The sale of electricity will take place under the conditions specified in the regulations of the aforementioned Energy Law and in accordance with the executive provisions issued for this Act, particularly with the standards for partner service, specified in the Regulation of the Minister of Climate and Environment of November 29, 2022, on the way of shaping and calculating tariffs and the method of settlements in the electricity trade (Journal of Laws of 2022, item 2505).
5) Settlements for the delivered electricity will be made based on invoices issued by the Contractor separately for specific Partners (indicated in Chapter I), within the time frames used by the OSD, according to the prices contained in the offer.
6) The payment term for the contractor's receivables:
a) 30 days for partners that are not healthcare entities (hospitals)
b) 60 days for partners that are healthcare entities (hospitals).
3. The Contractor calculates the offered price in Appendix No. 1A to the SWZ - “Price Form,” in which all costs associated with the execution of the subject of the contract must be included. The document, filled out according to the contracting authority's requirements and signed by the Contractor, will constitute an attachment to the offer submitted by the Contractor.
