Description:
The municipality seeks engineering services for energy efficiency renovations in multi-family residential buildings, including project preparation, construction works, and supervision, while limiting participation to two separated positions per bidder to encourage competition.

The scope of this public procurement includes the following activities for each of the separated positions: Activity 1 - preparation of an investment project in the phase of technical project; Activity 2 - execution of construction and assembly works according to the approved investment project; Activity 3 - exercising author's supervision during construction. The full volume of activities for each of the separated positions is indicated in the Technical Specification, which also serves as the Assignment for the Design for commissioning the Investment Project. Due to the nature of the project and the specifics of the activities, the contracting authority (the municipality) is a different entity from the owners of the intervention site, as it performs commissioning based on the concluded contract. The contracting authority has limited the "maximum number of separated positions" for which a single participant can submit an offer, namely to two. The motives for this are dictated by several factors. Firstly, limiting the number of separated positions that a participant can engage in implies greater competition and admission of more economic entities, i.e., encouraging competition. Furthermore, it will ensure the successful completion of the construction by mid-2027, as required for "Just Transition". The measure is lawful and provided for in Article 46, paragraph 4 of the Public Procurement Act, possessing corresponding advantages over the possibility of limiting "the number of separated positions that can be awarded to a single bidder". The chosen approach allows for more realistic competition, as the risk of refusal to conclude a contract due to winning another separated position is minimized, placing the Contracting Authority, which "acts on behalf of the condominium," in a situation of relative dependence on the contractor's will. "Introduction of Energy Efficiency Measures, Engineering - Design, Author's Supervision and Execution of Construction Works for the "Multi-Family Residential Building in Kyustendil, Gorotsvetna St. No. 50-52, Block 9, Entrances A and B".
The scope of the separated position includes the following activities: Activity 1 - Preparation of an investment project: Development of an investment project in the phase of "technical project" in accordance with Regulation No. 4 of May 21, 2001, regarding the scope and content of investment projects; In preparing the project, the selected contractor must comply with the mandatory measures for maintaining and securing the site prescribed in the Passport from the assessment of technical characteristics and in the Energy Audit Report and the Certificate for Energy Characteristics of Buildings in Operation. Activity 2 - Execution of construction works for the implementation of the project: The planned construction works include all activities for energy renovation - adopting measures for energy efficiency and all activities to apply the mandatory measures prescribed by the Technical Characteristics Assessment for the site, according to the developed investment project. The following energy-saving measures are foreseen, detailed in the Certificate for the Energy Characteristics of the building: Energy-saving measure 1 - Thermal insulation of external walls; Energy-saving measure 2 - Roof insulation; Energy-saving measure 3 - Floor insulation; Energy-saving measure 4 - Replacement of windows; Energy-saving measure 5 - Measures for lighting.
