Description:
Framework agreement for supplying reagents and consumables necessary for the operation of medical analysis laboratories, including related services and the establishment of a fully automated working line.

Framework agreement for the supply of reagents and consumables for the laboratory related to the necessary working equipment for carrying out activities within the medical analysis laboratory IRO Iasi, 48 months, according to the specifications in the terms of reference. Minimum and maximum quantities, their corresponding values, and other information regarding the execution of the framework agreement are provided in the TERMS OF REFERENCE and ANNEXES. The number of days until clarifications can be requested before the deadline for submitting offers is 15 days, according to art. 160 of Law 98/2016. The contracting authority will respond to all requests for clarifications/additional information on the 10th day before the deadline for submitting offers, according to art. 161 of Law 98/2016. Any request for clarifications must be sent through SEAP (http://sicap-prod.e-licitatie.ro/pub).

PURCHASE FOR LOT 1: Providing reagents and consumables compatible with the equipment made available, necessary for carrying out activities in the Medical Analysis Laboratory (LAM) of the Regional Institute of Oncology Iași. The supplier is obliged to ensure the supply of reagents, consumables, calibrators, internal controls, and all auxiliary materials necessary for performing laboratory tests, as well as related services (transport, installation, commissioning, training, and maintenance) throughout the duration of the framework agreement. The object includes the establishment of a fully automated working line for the IRO internal laboratory, according to the detailed technical requirements in the Terms of Reference. All expenses related to the supply, installation, training, maintenance, and any repairs of this equipment will be fully covered by the supplier throughout the duration of the framework agreement. This requirement is justified by the need to ensure the continuous operation of the fully automated working line, under conditions of complete compatibility between reagents and related equipment.

Legal basis: The request for free provision of strictly necessary equipment for the use of reagents is in accordance with: art. 3 para. (1) lit. rr) and art. 155 para. (6) of Law no. 98/2016, art. 20 para. (10) of the Annex to HG no. 395/2016, as well as with the interpretation provided by Case No. 897 (Library of ANAP cases, published on 11.05.2020), according to which this requirement is a technical specification justified by the objective needs of the contracting authority and does not represent a restriction on competition.

Given the complexity of the requested technical solution - namely the establishment of a fully automated working line that integrates pneumatic transport systems, aliquoting modules, and robotic storage - the contracting authority recommends a visit to the laboratory by interested economic operators, to fully understand the placement conditions, functional flows, and integration possibilities of the equipment. The visit is made based on a request for clarification sent through SEAP, and has exclusively informative character, without constituting a mandatory requirement or qualification criterion.

All economic operators will have available the space layout of the laboratory that the IRO technical service will make available for the auction. The economic operator is obliged to submit a sketch with the placement of the automated flow and other components (furniture, computers, chairs, cabinets, refrigerators, etc.) and equipment that are not part of it.

The framework agreement that will be concluded after the auction will come into force starting April 2026, after the end of the current framework agreement no. 9773/04.05.2022.
