Description:
The provision of public transport bus services in the area of operation of the Metropolitan Transport Board.

The subject of the sectoral contract shall be the provision of public transport bus services in the area of operation of the Contracting Authority, under the principles laid down in Annex No 7 to the SWZ — the draft provisions of the contract, also referred to as the “contract model”.

The order is divided into two parts also called “Segments”.

Segment “West C, Center D”

1. The subject of the sector contract is the provision of public bus services in the area indicated in Section II.2.3) of the notice (the main area in which the services will be provided).

2. The basic scope of operational work expressed in carriages (also referred to as “carriage”) to be commissioned by the Contracting Authority shall be:

Operational work [wozokm] broken down by type of rolling stock — basic range in the period: 01.07.2022 r. - 30.06.2030 r.: MN - 7 230 048 wagzokm; BN - 19 159 008 wagzokm; CN - 755 808 wagzokm. Total 27,144,864 wagzokm.

3. The Contracting Authority reserves the right to reduce the scope of the basic contract in each year of service performance (from 1 January to 31 December of the year concerned), in each type of rolling stock (MN, BN, CN), to a value of not less than guaranteed operational work in each year and the type of rolling stock which amounts to 85% of the operational work specified in point 2.

4. The dates for changes in the volume of operational work and the resulting change in the number of vehicles operating the Segment are set out in point 3.5. Specification of the Order Terms (SWZ).

5. The Contracting Party shall be entitled to request an extension of the scope of the contract under the option referred to in Article 441 (1) of the Pzp Act, in case of need to activate replacement communications in the area of operation of the Contracting Authority, under the conditions set out in the model contract Acting Annex 7 to the SWZ.

6. The range of options covers up to 15,3% of the subject of the contract in Part I: Segment “West C, Centre D”, Increase of the basic range and the required quantity of vehicles specified in point 3.7. SWZ.

7. The option will be implemented at a unit price not higher than the price referred to in § 7 (3) in the contract model set out in Annex 7 to the SWZ, taking into account the valorisation during periods and under the terms set out in Annex 12 'Valorisation of remuneration' to the Agreement.

8. The Contracting Authority requires that, from 1 July 2023, all vehicles shall be equipped with a monitoring system that meets the requirements set out in Annex 7 to the SWZ, in particular Annex 1 to the model contract.

9. The Ordering Party requires that, from 1 July 2023, all vehicles are equipped with USB chargers that comply with the requirements set out in Annex 7 to the SWZ, in particular Annex 1 to the contract model.

10. The Contracting Authority shall require that, from 1 July 2023, all vehicles shall be equipped with a device preventing the actuation of the engine by a driver under the influence of alcohol complying with the requirements set out in Annex 7 to the SWZ, in particular in Annex 1 to the model contract.

11. The Contracting Authority requires that from 1 July 2022 all vehicles shall be equipped with a Passenger Information System complying with the requirements set out in Annex 7 to the SWZ, and in particular Annex 8a to the model contract. The dates for the introduction of selected functionalities are set out in Annex 8a to the model contract.

12. The Contracting Authority requires that, within 3 months of the date of conclusion of the Agreement, all vehicles carrying out the subject of the contract have colours of outer plating in yellow [RAL 1018].

13. Pursuant to Article 95 (1) of the Pzp Act, the Contracting Authority requires employment by the Contractor or subcontractor on the basis of the working relationship of the drivers of vehicles, i.e. persons carrying out the operation of the operation in the manner laid down in Article 22 (1) of the Act of 26 June 1974 - Labor Code (Journal of Laws of 2020, item 1320, as amended).

14. The method of verification of employment referred to in point 13, the Contracting Authority described in paragraph 3.19 of the SWZ.

15 In accordance with Article 91 (1) of the Pzp Act, the Contracting Authority shall allow the submission of an offer by one Contractor for up to one part of the contract (Part I or Part II).

Segment “East C, South B”

1. The subject of the sector contract is the provision of public bus transport services in the area indicated in Section II.2.3) of the announcement, as well as Siemianowice Śląskie, Siewierz, Sławków, Sosnowiec, Tarnowskie Góry, Tychy (the main area where services will be provided).

2. The scope of the basic operating work expressed in the carriage to be commissioned by the Contracting Authority shall be:

Operational work [wozokm] broken down by type of rolling stock — basic range in the period: 01.07.2022 r. - 30.06.2030 r.: MN - 13.346.084 wozokm; BN - 24.344.007 wozokm; Total 37.690.091 wagzokm.

3. The Contracting Authority reserves the right to reduce the scope of the basic contract in each year of service performance (from 1 January to 31 December of the year concerned), in each type of rolling stock (MN, BN), to a value of not less than guaranteed operational work in each year and a rolling stock type which amounts to 85% the operational work referred to in point 2.

4. The dates for changes in the volume of operational work and the resulting change in the number of vehicles operating the Segment are set out in point 3.5. Specification of the Order Terms (SWZ).
