The subject of the contract is the implementation of the service of collecting municipal waste from the owners of real estate residing in the municipality of Kosakowo and their development.
2.Us long includes:
1) selective collection of municipal waste (in accordance with the Regulations for maintaining cleanliness and order in the kosakowo commune in force during the term of the contract - Annex 12 to the SWZ) 10 fractions of waste.
2) collection of the above-mentioned municipal waste from containers / bags for municipal waste, with a capacity of
and in the colors specified in the Regulations for maintaining cleanliness and order
in the municipality of Kosakowo – Annex No. 12 to the SWZ and with the frequency specified in Annex 13 to the SWZ regarding the detailed manner and scope of providing services in the field of collecting municipal waste from owners of inhabited properties and managing this waste
3) management of collected municipal waste.
The Contractor's duties include:
1. The Contractor is obliged to perform the subject of the contract in accordance with
with the applicable provisions of the environmental protection law, the Waste Act, the Act on maintaining cleanliness and order in municipalities and their executive acts, as well as in accordance with the resolutions of the Kosakowo Commune Council regulating the municipal waste management system in the Kosakowo Municipality.
2. The Contractor is obliged to collect mixed municipal waste
and separately collected in quantities and with the frequency specified in the resolution of the Kosakowo Commune Council on the detailed manner and scope of providing services in the field of collecting municipal waste from property owners and managing this waste
3. The Contractor is obliged to collect mixed municipal waste
and segregated collected in containers and bags that meet the requirements set out in the resolution of the Kosakowo Commune Council on the regulations for maintaining cleanliness and order in the Kosakowo commune.
4. The Contractor is obliged to collect waste continuously, within the deadlines resulting from the adopted schedule of municipal waste disposal, regardless of difficulties resulting from road conditions (e.g. repairs, road reconstructions, etc.) or weather conditions.
In the event of technical difficulties (in particular the impossibility of access due to works carried out on the roads), the Contractor is obliged to inform the Ordering Party by phone or e-mail at the latest on the day of the date of export about the inability to reach the places of waste collection. The lack of such information will be treated as a failure to carry out the collection of waste.
5. The Contractor is obliged to collect municipal waste from problem areas (e.g. narrow streets, unpaved roads, forest areas, etc.).
6. In the event that access roads to the property (e.g. narrow, unpaved, etc.) prevent access by garbage truck, it should be ensured that municipal waste is collected using other equipment (e.g. a smaller vehicle) or another method.
7. The collection of waste must take place in vehicles adapted to collect the different fractions of municipal waste, in such a way as to exclude mixing of this waste. Each fraction of waste should be collected and transported in a separate vehicle or vehicle with separate compartments.
8. The Contractor is obliged to perform the subject of the contract in an efficient manner, preventing spillage, exhaust, pouring waste and minimizing traffic difficulties.
9. The Contractor is obliged to collect waste in a way that ensures the maintenance of an appropriate sanitary condition, in a way that prevents waste from spilling out of containers and bags during the performance of the municipal waste collection service.
10. As part of the performance of the contract, the Contractor is obliged to:
a. collecting waste from the place of making the container available and after emptying the container, putting it in the same place,
b. tidying up the place, in the event of waste spilling during the service.
11. The Contractor is obliged to control the implementation by the property owners of the obligations of selective collection of municipal waste, specified in the Regulations for maintaining cleanliness and order in the Kosakowo Municipality.
12. The Contractor is obliged to collect municipal waste on weekdays, excluding public holidays.
13. The Contractor is obliged to transfer the mixed municipal waste collected from the owners of the property directly to the municipal installation.
14. The Contractor is obliged to transfer separately collected municipal waste collected from property owners directly or through another waste collector to a waste recovery or disposal facility, in accordance with the hierarchy of waste management methods referred to in Article 17 of the Waste Act of 14 December 2012 (i.e. Journal of Laws of 2022, item 699, as amended).
