The procurement procedure will be conducted as a dynamic procurement system in accordance with § 4b EU Para. 1 VOB/A in conjunction with §§ 22, 23, 24 VgV by means of a non-open procedure. The dynamic procurement system is set up to award construction services for the establishment of the subsidized passive fiber optic network for Breitband Ortenau GmbH & Co. KG in the Ortenaukreis to suitable companies. The dynamic procurement system is an entirely electronic, open procurement procedure for its entire duration. - Initially, the suitability of the companies will be examined, and suitable applicants will be admitted to the system. - For each specific need, all approved companies will be invited to submit offers. - New companies can submit a participation application at any time during the term of the system; these will be admitted for future individual awards, provided they meet the established suitability criteria. In the participation competition (first procedural stage), any interested company can submit a participation application. In this procedural stage, companies will be assessed for their suitability based on the submitted documents and the absence of exclusion criteria. No offer documents are required at this procedural stage! Companies can apply for admission during the entire duration of the dynamic procurement system and have their suitability checked for the respective individual tenders. The awarding authority will review the submitted participation applications in accordance with § 24 Para. 3 S. 1 VgV within 10 working days and promptly inform applicants of their admission or non-admission. Attention is drawn to § 24 Para. 3 S. 2 VgV. Approved companies will then be invited to submit an offer for each subsequent individual tender, provided they meet the suitability criteria for the respective individual tender (reference type 1-3) (see Chapter VI.5.1 of the application conditions). The first request for offers is scheduled for early June 2026. Companies that are not yet approved at the time of sending a request for offers cannot be considered for the affected individual tender. However, they will be considered for future individual tenders if they receive approval. The most economically advantageous offer will be determined based on the published award criteria (the price will be the only criterion). The requirements for offers and the terms/regulations for the individual procurement measures will be communicated in the respective request for offers. Attention is drawn to the conditions for the execution of the contract (Chapter IX of the application conditions). Further requirements remain reserved. Breitband Ortenau GmbH & Co. KG intends to establish a passive fiber optic network in the Ortenaukreis in the municipalities of Bad Peterstal-Griesbach, Biberach, Durbach, Ettenheim, Fischerbach, Gutach, Hausach, Hohberg, Hofstetten, Hornberg, Lautenbach, Mühlenbach, Nordrach, Oberharmersbach, Oberkirch, Oberwolfach, Oppenau, Ottenhöfen, Schuttertal, Seelbach, Steinach, Wolfach, Zell am Harmersbach and to expand the existing (or partly still under construction) passive fiber optic network. The construction services include, among others, the installation of empty conduits, the assembly of fiber optic cables, splices, manholes, the construction of technical buildings and multifunctional cabinets including optical splitters as well as the creation of house connections including fiber optic installation including the provision of splice work and other associated assembly work (e.g., installation of APL) and fiber measurement (OTDR).
