Description:
Establishment of a Dynamic Procurement System for supplying construction materials across four categories for the State Water Holding Polish Waters, allowing participation in one or multiple categories as needed.

1. The subject of the contract is the establishment of a Dynamic Procurement System (hereinafter referred to as DPS) for awarding contracts for the supply of construction materials for units of the State Water Holding Polish Waters.
2. The subject of the contract within the DPS has been divided into four categories: Category No. 1 - Supply of construction materials, Category No. 2 - Supply of electrical and lighting articles, Category No. 3 - Supply of fittings, hydraulic articles, and water-sewage, Category No. 4 - Supply of hand tools and accessories. The contracting authority allows the submission of applications for admission to participate in the DPS for one, several, or all categories.
3. The expected quantities of materials specified in the description of the subject matter of the contract, divided by individual categories, are given estimatively. Qualification of contractors to the DPS in individual categories does not constitute a basis for claims to fulfill deliveries in the quantities indicated in the description of the subject matter of the contract since at this stage of the DPS’s validity, neither party incurs an obligation. Specified quantities of materials in individual categories will be indicated each time at the stage of commencing procedures for awarding executing contracts covered by the DPS.
4. Procedures for awarding executing contracts within the established DPS in all categories may be conducted by individual Regional Water Management Authorities. The locations for deliveries will be specified in the invitation to submit bids. The list of Units authorized to conduct procedures for awarding executing contracts and granting executing contracts, along with indicating the planned delivery locations, is included in Annex No. 6 to the SWZ.
5. Ordering deadlines - The contracting authority will initiate/launch orders granted within the DPS as needed on an ongoing basis. At the time of establishing the DPS, the contracting authority cannot provide a detailed schedule/date for the initiation of orders within the DPS. The deadlines for executing individual orders awarded within the DPS will always be determined in the invitation to submit bids.
6. A detailed description of the subject matter of the orders covered by the DPS, along with the estimated quantities, is included in Annex No. 5 to the SWZ.
7. The method of operation of the DPS:
1) After the commencement of the procedure for establishing the DPS, contractors submit applications for admission to participate in the DPS within the designated time along with the required statements (JEDZ and sanction statement) concerning the category they apply for (the model application is shown in Annex No. 1 to the specification of contract terms - hereinafter referred to as SWZ);
2) The contracting authority qualifies the applicant contractor who submitted the application for admission to participate in the DPS in a given category based on the content of the JEDZ statement and the sanction statement within the time indicated in Article 320 of the Public Procurement Law, counting from the date of opening applications;
3) After the first qualification of contractors and the establishment of the DPS, those contractors not covered by the DPS in a given category will have the opportunity to submit an application for admission to participate in the DPS during the entire period of its validity. After sending the invitation to submit bids regarding the first order covered by the DPS, no further deadlines for submitting applications for admission to participate in the DPS will be set. Qualification of applications for admission to participation in the DPS that are submitted during the validity of the DPS will be carried out similarly, within the deadlines indicated in Article 320 of the Public Procurement Law;
4) If the contracting authority has not qualified the application for admission to participate in the DPS submitted during its validity and a procedure for awarding an executing contract has been commenced, i.e., an invitation to submit bids has been sent, then such a contractor, upon a positive verification of eligibility, will be able to participate only in the next procedure for awarding an executing contract covered by DPS in the category to which they have been qualified;
5) Throughout the entire period of the DPS’s validity, the contracting authority may call on contractors admitted to participate in the DPS to submit a new and updated JEDZ statement within 5 working days from the date of the call, based on Article 322 of the Public Procurement Law;
6) Executing orders covered by the DPS in individual categories will be awarded after conducting the procedure for awarding a specifically defined executing contract, in accordance with the principles specified in Article 323 of the Public Procurement Law:
a) The contracting authority invites all contractors participating in the DPS to submit bids for each executing order covered by the DPS, within no less than 10 days from the date of sending the invitation to submit bids (the model invitation for submitting a bid is included in Annex No. 7 to the SWZ);
b) The contracting authority, after receiving the bids, examines them regarding compliance with the requirements specified in the description of the subject matter of the contract, considering the needs of the contracting authority at the time of announcing the executing order, which will be sent along with the invitation to submit bids. The contractor whose offer is rated the highest will be invited to submit the documents required on the date of submitting the eligible documents specified in point 13.3 of the SWZ within no shorter than 10 days;
c) The contracting authority selects the best offer from the contractors among the offers not subject to rejection based on the bid evaluation criteria specified in point 18.3 of the SWZ and in the announcement of the order and detailed in the Invitation to submit bids;
8. The contracting authority allows the participation of subcontractors in the execution of the order. In the case of the participation of subcontractors in the execution of the order, the contracting authority, in accordance with Article 462 (2) of the Public Procurement Law, requires the contractor to indicate in the offer parts of the order that they intend to entrust to subcontractors and provide the names of subcontractors, if known. Assigning the execution of parts of the order to subcontractors does not relieve the contractor of responsibility for the proper execution of the order. Requirements regarding subcontracting are specified in § 10 of the contract.

Category No. 1 - Supply of construction materials.
1. The subject of this category is the supply of construction materials, particularly: construction materials and similar elements, paints, varnishes, and wood protection products, construction carpentry elements, various construction materials, fences, seeds, floor coverings, gravel, sand, crushed stone, and aggregates.
2. A detailed description of the subject matter of the contract is included in Annex No. 5 to the SWZ.

Category No. 2 - Supply of electrical and lighting articles.
1. The subject of this category is the supply of electrical and lighting articles, particularly: devices and equipment for electric power distribution, insulated wires and cables, batteries, primary cells and batteries, lighting devices and electric lamps, electrical equipment and apparatus, pipelines, pipes, pipe covers, hoses and fittings, tools, locks, keys, hinges, and hardware, chemical products, synthetic and artificial fibers (preparations).

Category No. 3 - Supply of fittings, hydraulic articles, and water-sewage.
1. The subject of this category is the supply of fittings, hydraulic articles, and water-sewage materials, particularly: pipelines, pipe installations, pipes, pipe linings, pipes and similar elements, sets of batteries, bathroom and kitchen articles, shower cabins, electric water heaters (instant or accumulative) and immersion heaters, taps, faucets, valves, and similar fittings, pumps, mastics, fillers, sealants, sanitary products, transmission pipe cables, and accessories.

Category No. 4 - Supply of hand tools and accessories.
1. The subject of this category is the supply of hand tools and accessories, particularly: machine tools, tool sets, tools, locks, keys, hinges, fasteners, chains, and springs, parts of hand tools, laboratory, optical, and precision equipment (except glass), ladders, trolleys.
