The subject of the contract are services in the field of forest management as defined in Article 6(1)(1) of the Forest Act of 28 September 1991 (consolidated text: Journal of Laws of 2022, item 672 – "Forest Act") covering works in the field of forest breeding and protection, fire protection, logging and skidding and tourist management, by-use of forest, maintenance of fire roads and seed

to be performed in the area of the Trzebież Forest District in 2023. The procedure is conducted in an open tender procedure pursuant to Article 129(1)(1) in conjunction with Article 129(2) and Articles 132-139 of the Act of 11 September 2019. Public procurement law (consolidated text: Journal of Laws of 2022, item 1710, as amended) and implementing acts to the Public Procurement Law, in accordance with the rules provided for classic contracts with a value equal to or exceeding the EU thresholds and in accordance with the rules provided for the so-called "reverse procedure" referred to in Article 139(1), (3-4) of the Public Procurement Law.

The subject of the contract are services in the field of forest management in accordance with the definition in Article 6 paragraph 1 point 1 of the Act of 28 September 1991 on forests (consolidated text: Journal of Laws of 2022, item 672 – "Act on forests") to be performed in the Forest District Trzebież in 2023 in the Myślibórz forestry.

The material scope of the contract includes the total quantities of works resulting from Annex 2 to the SWZ, which consist of Annexes No. 2.1. to No. 2.4.2. The material scopes resulting from Annex 2 are estimates.

Quality standards relating to all essential features of the subject of the contract are specified in Annex 3 to the SWZ, which consists of:

(a) Appendix No. 3.1. "Description of the standard of forestry work performance technology" adopted by Decision No. 34 of the General Director of the State Forests of May 12, 2022 on the introduction of the "Description of the standard of forestry work performance technology" in organizational units of the State Forests (EZ.011.13.2022) and Decision No. 86 of the General Director of the State Forests of July 19, 2022 on the amendment of the annex to Decision No. 34 of the General Director of the State Forests of May 12, 2022 on introduction to the use of the "Description of the standard of forestry work performance technology" in organizational units of the State Forests (MZ.011.4.2022); (b) Appendix No. 3.2. "Description of the standard of forestry work performance technology in the Regional Directorate of State Forests in Szczecin adopted by Decision No. 64 of the Regional Director of the State Forests of August 19, 2022 on the introduction of the "Regional description of the standard of forestry work performance technology" in organizational units of the State Forests subordinate to the Regional Directorate of State Forests in Szczecin. Specified in Annex 3.1. to the SWZ and in Annex 3.2. to the SWZ a detailed description of the technology standard for performing individual forestry works (activities) is the basis for determining the quality requirements relating to the elements making up the subject of the contract (Annex 2 to the SWZ). If the action described in the above-mentioned annexes has not been provided for in the description of the subject of the contract (Annex No. 2 to the SWZ), then in this respect the provisions of Annex No. 3.1. to the SWZ and in Annex No. 3.2. to the SWZ do not apply.

Descriptions of activity codes describing individual forestry works (activities) included in the subject of the contract, description of the rules of the procedure for acceptance of forestry works are described in Annex 3 to the SWZ.

Pursuant to Article 95 of the Public Procurement Law, the Contracting Authority requires the Contractor or a subcontractor to employ persons performing activities in the scope of contract performance consisting in obtaining and skidding wood raw material, if the performance of these activities consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 - Labour Code (consolidated text: Journal of Laws of 2022, item 1510, as amended. died.).

The Ordering Party demands a deposit of PLN 10,000.

Security for proper performance of the contract - 2% of the total price of a given Package [PLN gross].

The Ordering Party does not reserve the obligation of the Contractor to personally perform key tasks regarding the subject of the contract. The Contractor may entrust the implementation of elements (parts) of the subject of the contract to subcontractors.

The material scope of the contract includes the total quantities of works resulting from Annex 2 to the SWZ, which consist of attachments from No. 2.1., 2.2, 2.4.1, 2.4.2. The material scopes resulting from Annex 2 are estimates.
