Delivery and implementation will take place in accordance with the principles set out in the ToR, including the description of the subject of the order and the contract template in accordance with the form.
2. The description of the subject of the contract sets out the quality standards referred to in Article 91 (2a) of the Public Procurement Law.
3. Subject scope
In addition to the guaranteed order, including the delivery and implementation of 1 disk array and 14 NL-SAS disks, the Purchaser reserves the right to fulfill the order covered by the option right.
The option right will consist in providing elements indicated by the Ordering Party (up to 14 NL-SAS disks) and implementing them in the abovementioned matrix.
The description of the elements covered by the option right is on the form the description of the subject of the order.
4. A detailed description of the subject of the contract is contained in the form description of the subject of the contract, which is an integral part of the ToR.
5. The contract will be carried out under the conditions set out in the contract template, which is an integral part of the Terms of Reference. The model contract provides for and specifies the terms of any change to the content of the contract.
6. The contractor should provide in the form of the description of the subject of the contract the name of the manufacturer and the model name of the offered elements (in the case of disk also capacity).
The form, description of the subject of the contract, including the manufacturer's name and model name indicated by the Contractor (in the case of disk also capacity), make up the content of the offer.
7. Deadline for the contract:
a) performance of a guaranteed order - within 60 days from the date of the contract, subject to the provisions of §7 of the model contract,
b) if the Employer exercises the option right, the Employer shall provide the Contractor with one-time information on exercising or not exercising the option right within 21 days from the date of the contract. The Contractor will be obliged to deliver the subject covered by the option right within 60 days from the day of informing about exercising the option right. The information will be provided to the Contractor in writing. If you exercise the option right, the Employer will indicate the number of items ordered.
c) Software licenses provided as part of the contract (computer software licenses) will be granted for an indefinite period.
9. The contractor should submit the following statements, the content of which is on the form, description of the subject of the contract:
a) We declare and undertake that the array and disks offered and delivered by us will be brand new and manufactured not earlier than in the second half of 2018. The definition of brand new equipment does not include equipment re-introduced to the market by the equipment manufacturer after the process of its "refurbished". The Purchaser does not allow delivery of arrays or disks re-placed on the market by the manufacturer after the "refurbished" process.
b) We declare and undertake that the matrix and disks offered and supplied by us will be manufactured in accordance with applicable law and standards, will be fully valuable
And fit for use for their intended purpose and will have CE declarations of conformity.

From a legal source and will be covered by a package of warranty rights (under the conditions described in the Terms of Reference,

To all patches and the latest versions of the software made available by the manufacturer, including the right to download them directly from the manufacturer's website or otherwise made available by the Contractor, install and use without infringing the rights of other persons or entities
