The concession has as its object the realization of public works of restructuring and / or adaptation of part of the building complex, to be carried out with totally private investments and without financial charges borne by the municipal administration and its subsequent management. For the purpose of identifying the type of concession as a works concession, reference is made to art. 169 paragraph 1 of Legislative Decree 50/2016 together with the now consolidated jurisprudence for which, if the assignment contemplates the execution of the works together with the management of a service, "the demarcation line between the different institutes must be identified having in mind the direction of the instrumental link that links the management of the service and the execution of the works".
