For the purpose of identifying the type of concession as a works concession, reference is made to art. 169 paragraph 1 of Legislative Decree 50/2016 together with the now consolidated jurisprudence for which, if the assignment contemplates the execution of the works together with the management of a service, "the demarcation line between the different institutes must be identified having in mind the direction of the instrumental link that links the management of the service and the execution of the works".
