Description:
COLLECTION AND MANAGEMENT OF MUNICIPAL SOLID WASTE FROM INHABITED PROPERTIES LOCATED IN THE DRAGACZ COMMUNE ALONG WITH THE DELIVERY OF EQUIPMENT AND BAGS FOR WASTE COLLECTION IN 2023

The subject of the contract includes the performance of a service within the municipality of Dragacz, consisting of:

1. the receipt and development of mixed and selectively collected municipal waste from property owners residing in the municipality of Dragacz;

2. the receipt and development of segregated municipal waste from the municipal waste collection point (PSZOK) at the municipal wastewater treatment plant in the Lower Group;

3. equipping the property with containers and bags used to collect mixed and segregated municipal waste and PSZOK with containers and containers;

4. to develop and provide the Ordering Party and the owners of inhabited property with a timetable for receiving waste and an educational leaflet, including instructions on how to segregate municipal waste and what waste into which container/bag should be dumped.

A detailed description of the item of the order is specified in the Order Terms Specification.

The subject of the contract includes the collection of municipal waste from property owners and their management in accordance with the Regulations for maintaining cleanliness and order in the municipality – Resolution of the Dragacz Commune Council No. XVI/173/20 of 25 September 2020 on the regulations for maintaining cleanliness and order in the Dragacz commune - Appendix No. 8.1 to SWZ, Resolution of the Dragacz Commune Council No. XXXI/339/22 of 28 April 2022 on the amendment of the regulations for maintaining cleanliness and order in the Commune Dragacz - Appendix No. 8.2 to SWZ, Resolution of the Dragacz Commune Council No. XXXIV/361/22 of 21 July 2022 amending the resolution on the regulations for maintaining cleanliness and order in the Dragacz Commune - Appendix No. 8.3 to the SWZ and resolution of the Dragacz Commune Council No. XVI/174/20 of 25 September 2020 on determining the detailed manner and scope of providing services in the field of collecting municipal waste from property owners and managing this waste, in exchange for a fee paid by the owner of the property for municipal waste management – Appendix No. 9.1 to the SWZ and Resolution of the Dragacz Commune Council No. XXXIV/362/22 of 21 July 2022 amending the resolution on determining the detailed manner and scope of providing services in the field of collecting municipal waste from property owners and managing this waste, in exchange for a fee paid by the property owner for municipal waste management – Attachment No. 9.2 to SWZ.

The Contractor will receive and use directly from the property inhabited the following types of municipal waste:

1) unsegregated (mixed) municipal waste,

2) bioodpady,

3) plastics, metals and multi-material packaging,

4) glass waste,

5) paper and cardboard,

6) furniture waste and other bulky waste (1 time per year),

7) waste electrical and electronic equipment (1 time per year),

8) used tires (1 time per year),

9) waste textiles and clothing (1 time per year).

The Contractor will handle, collect and manage the following waste from the Selective Municipal Waste Collection Point:

1) paper and cardboard,

2) metals, plastics,

3) multi-material packaging waste,

4) glass,

5) bioodpady,

6) hazardous waste,

7) expired drugs and chemicals,

8) waste not classified as medical waste generated in the household, as a result of taking medicinal products in the form of injections and monitoring the level of substances in the blood, in particular needles and syringes,

9) waste of textiles and clothing,

10) waste batteries and accumulators,

11) waste electrical and electronic equipment,

12) furniture and other bulky waste,

13) construction and demolition waste,

14) used tires.

Wastes listed in point 2.3.2. and 2.3.3. have been classified on the basis of the Regulation of the Minister of Climate of 2 January 2020 on the waste catalogue (Journal of Laws, item 10) and fall within the group marked with the code: 15 – packaging waste; sorbents, wiping cloths, filter materials and protective clothing not included in other groups, 16 – waste not included in other groups, 17 – waste from the construction, renovation and dismantling of buildings and road infrastructure (including soil and soil from contaminated areas), 20 – municipal waste including selectively collected fractions.

The Contractor will collect the above waste and then manage it in the amount in which the owners of the properties on which the residents live will dispose of. The estimated amounts of municipal waste are set out below, however, the Ordering Party reserves that it does not guarantee the execution of the order in such quantity.

List of localities within the administrative boundaries of the Dragacz municipality:

The gmina contains the villages of Wiąskie Piaski, Wielkie Stwolno, Polskie Stwolno, Bratwin, Michale, Dragacz, Wielki Lubień, Wielkie Zajączkowo, Fletnowo, Dolna Grupa, Górna Grupa, Stare Marzy, Nowe Marzy, Mniszek and Grupa. The administrative area of the Dragacz commune and the location of the village according to the overview map of the administrative area of the Dragacz commune – Appendix No. 10 to the SWZ.

Estimated number of inhabitants – approx. 5570, including:

1) in single-family buildings – approx. 4090 (including people with a composter – approx. 791),

2) in multi-family buildings up to and including 7 premises – approx. 280,

3) in multi-family buildings over 7 premises – approx. 1200.

Estimated number of inhabited properties:

1) single-family buildings – approx. 1576 (including the number of composters – approx. 247),

2) multi-apartment buildings up to and including 7 premises – approx. 19,

3) multi-apartment buildings over 7 units (Group) – approx. 17.

Collection and management of municipal waste will take place from all owners of real estate residing in the municipality of Dragacz - existing as well as from those reported during the implementation of the subject of the contract.

When preparing the offer, the Contractor (during the period of performance of the subject of the contract) should, at its own risk, take into account the possible changes in the number of households and the amount of waste.

The Contractor shall be liable for damages caused during and in connection with the implementation of the subject of the contract on the terms set out in the Civil Code. The Contractor should have civil liability insurance in the scope of business activity, valid for the entire period of performance of the subject of the contract, appropriate to the subject of the contract.

The Contractor will collect all municipal waste generated on the premises of the property where the residents live, collected in containers and bags that meet the requirements set out in the Regulations for maintaining cleanliness and order in the Dragacz Commune and this documentation.

The Contractor should immediately notify the Ordering Party of obstacles to the implementation of the subject of the contract.

The Contractor is obliged to achieve an appropriate level of preparation for re-use and recycling of municipal waste, in accordance with Article 3b of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal of Laws of 2022, item 1297) and in accordance with the regulations on recycling levels issued by the Minister of the Environment, Resolution No. XXXII/546/17 of the Kujawsko-Pomorskie Voivodeship Assembly of 29 May 2017 on the implementation of the "Waste Management Plan of the Voivodship Kujawsko-Pomorskie for the years 2016–2022 with a perspective for the years 2023–2028" (Dz. Province Kuj.-Pom. item 2403).

The Contractor is obliged to return to the Ordering Party, within 14 days from the date of receipt of the request, the amount equivalent to the penalty imposed on the Municipality of Dragacz for failure to comply with the obligations set out in Article 9z of the Act on maintaining cleanliness and order in municipalities, only to the extent covered by the subject of the contract. The penalty does not apply in the event of suspension of payment of a financial penalty to the Dragacz Municipality and subsequent cancellation in accordance with Article 9ze of the aforementioned Act.

The Contractor is obliged to meet the following requirements:

1) having a current entry in the register of regulated activities kept by the Mayor of the Dragacz Commune in accordance with Article 9c(1) of the Act on maintaining cleanliness and order in municipalities (i.e. Journal of Laws of 2022, item 1297),

2) having a current entry in the register of entities introducing products, products in packaging and waste management, referred to in Article 49 of the Act of 14 December 2012 on waste (i.e. Journal of Laws of 2022, item 699),

3) in the case of transferring waste to another entity for the purpose of its recovery or disposal, concluding a contract with an entity with an appropriate permit and providing the Ordering Party with a copy of this contract by the date of commencement of the implementation of the subject of the contract.

The Contractor is obliged to comply with the applicable provisions of law regarding waste management and health and safety and fire protection regulations, performing the service in a way that is not burdensome for the environment, residents and ensures the safety of persons and property.

The Ordering Party reserves the right to control the Contractor in terms of meeting the conditions contained in this description.
