The subject of the public contract is the gradual delivery of medicinal products and medical devices for the needs of the Regional Pharmacy ZOZ at the Remand Center in Lublin.
The size and scope of the order is specified in Annex 2 to this Specification of the Essential Terms of the Order.
1. The subject of the public contract is the gradual delivery of medicinal products and medical devices for the needs of the District Pharmacy ZOZ at the Remand Center in Lublin.
2. The Contractor may, while maintaining the form and dose of the drug, offer a chemically equivalent pharmaceutical product (generic), with a different packaging size than that given in the Annex, retaining the total required number of unit items (tablets, ampoules, etc.), then the amount should be recalculated packaging and round it up to the full packaging.
3. The Employer allows the possibility of valuation of alternative injection forms - e.g. ampoule vial.
4. The Awarding Entity allows the possibility of valuation of alternative forms of oral preparations, ie:
- tablets - coated tablets, capsules (including hard and flexible) or dragees,
- coated tablets - tablets, capsules (including hard and flexible) or dragees,
- capsules (including hard and flexible) - coated tablets, tablets or dragees,
- dragees - capsules, tablets or coated tablets,
instead of (tablets, coated tablets or hard and flexible capsules) slow-acting - modified-action.
5. The Purchaser does not allow changes to insulins.
6. The subject of the order must be admitted to trading on the territory of the Republic of Poland in accordance with the announcement of the President of the Office for Registration of Medicinal Products, Medical Devices and Biocidal Products:
1) of 30.3.2017 regarding the announcement of the Official List of Medicinal Products Authorized for Marketing in the Territory of the Republic of Poland (Journal of Min. Health, item 45);
2) of 16.4.2018 regarding the publication of the Official List of Medicinal Products Authorized for Marketing in the Territory of the Republic of Poland (Journal of Laws of the Ministry of Health item 23);
3) of 5.6.2019 on the announcement of the Official List of Medicinal Products Authorized for Marketing in the Territory of the Republic of Poland (Journal of Laws of the Ministry of Health item 44).
7. The period of validity of the products offered may not be less than 12 months (from the date of delivery) to the end of the period of validity, unless the Purchaser agrees to accept the product with a shorter validity period.
8. The Employer may accept generics (equivalents) of pharmaceutical products at the Contractor's disposal as part of the range offered. In this case, the Ordering Party shall pay for the generics (equivalents) delivered, no higher than the price of the product from the signed contract.
9. The quantities quoted in the tender may change subject to the unit price.
10. The Awarding Entity allows the exchange of a preparation valued in the tender for another equivalent, while maintaining the unit price (suspension or termination of production).
11. The final number of individual articles will result from the actual needs of the Employer during the contract period.
