1. Contract name: "Grass and weed mowing services and chemical weed control in the provincial roads road lane in the RDW Toruń administration in the years 2020–2021 divided into 2 parts".
2. The contract shall cover the following scope for Lot I and Lot II:
a) mowing grasses, weeds and suckers on the mown surface in the road lane and in the yard at the headquarters of RDW Toruń. By the cut surface in the road lane is meant a roadside, a ditch, an escarpment, an anti-escarpment, separation belts and green belts within cities;
b) removal of cut grass, weeds and suckers from urban areas;
c) chemical weed control on bus bays, sidewalks, pedestrian and bicycle routes, cycle paths, etc.
A detailed description of the subject of the contract is in the ToR.
PART IThe contract covers the following scope for Lot I and Lot II:
a) mowing grasses, weeds and suckers on the mown surface in the road lane and in the yard at the headquarters of RDW Toruń. By the cut surface in the road lane is meant a roadside, a ditch, an escarpment, an anti-escarpment, separation belts and green belts within cities;
b) removal of cut grass, weeds and suckers from urban areas;
c) chemical weed control on bus bays, sidewalks, pedestrian and bicycle routes, cycle paths, distribution islands, etc.
- cut grass, weeds and bush shoots in cities should be picked up in piles and folded off the road crown and taken away by road transport, and then cleared of the road lane within 2 days at the latest;
d) removal and utilization of cut grass, weeds and shrubs in cities from the road lane will be at the contractor's expense. The contractor will provide services in the road lane in a way that does not impede the movement of vehicles and does not threaten the safety of road users;
e) the contractor should provide services without causing damage to the existing road infrastructure.
3. The Contractor is obliged to comply with the provisions in force in the field of waste disposal, in particular the provisions of the Act of 27 April 2001 on waste (Journal of Laws of 2019, item 701, as amended) hereinafter referred to as the "Act waste ". The service contractor will also be a "waste producer" within the meaning of § 3 para. 1 point 3 of the "Waste Act".
4. The order will be carried out on the basis of written execution orders, indicating the scope of the work ordered, the bill of lading, location, order of service and deadline for the delivery to the Contractor by fax or electronic means of communication within the meaning of the Act of 18 July 2002 on the provision of services electronically (i.e. Journal of Laws of 2019, item 123, as amended). When determining the date of implementation, the Employer accepts the principle that the Contractor should perform the services covered by the subject of the contract for 6 km of road within 1 calendar day. The length of the date will be adjusted in proportion to the number of kilometers ordered in a given command.
5. The order will be implemented on provincial roads administered by RDW Toruń. The Purchaser reserves the right to increase or decrease the number of roads and change their length during the performance of the contract as a result of possible organizational changes, classifying roads of other categories into voivodship roads and vice versa, taking over or transferring roads from other managers on the basis of separate provisions. The list of roads is attached as Annex 12 to the ToR.
6. During the contract, the Contractor is required to mark the road section along the length of the works with the signs A 14 "road works", means of transport and other wheeled equipment used to perform the contract must be mandatorily equipped with warning lamps and signs A 14 "works on road 'and C 10' driving order on the left of the sign '.
7. Employer pursuant to art. 29 paragraph 3a of the PPL, requires employment by a contractor or subcontractor on the basis of an employment contract of persons performing the activities referred to in point V. 1.3.2. b).
