The subject of the contract is the provision of services related to the performance of the function of the Contract Engineer for the project entitled: "Reconstruction of Aleja Wojska Polskiego - DK 1 in Częstochowa". The current designation of the road number is DK 91 as described in the SWZ.

The project entitled: "Reconstruction of Aleja Wojska Polskiego - DK 1 in Częstochowa (currently DK 91)" will be implemented in accordance with contract No. 323/2022 of 13/09/2022 for the execution of construction works, concluded with the Contractor of Construction Works: Consortium Leader - NDI S.A., Powstańców Warszawy 19, 81-718 Sopot and Consortium Partner - NDI SOPOT S.A., Powstańców Warszawy 19, 81-718 Sopot (hereinafter referred to as the "Contract").

1. The Contractor shall be responsible, inter alia, for:

1.1. Management of the Contract on behalf of the Ordering Party throughout its implementation.

1.2. Performing the function of the Contract Engineer in accordance with the role assigned to the Contract Engineer in the Contract, as well as performing the function of the investor's supervision inspector in accordance with the provisions of Polish law and the provisions of relevant construction permits, performing the function of coordinator of the investor's supervision team within the meaning of Article 27 of the Construction Law over works in the scope of:

a) Engineering structures;

b) Construction of road surfaces, bicycle and pedestrian routes;

c) Construction of road drainage;

d) Construction of road lighting;

e) Construction of sound-absorbing and acoustic screens;

(f) Demolition works;

(g) Reconstruction of conflicting underground and above-ground infrastructure facilities;

h) Landscaping;

i) Other works related to the implementation of the Contract.

1.3. Acting as a verifier of replacement design documentation developed by the contractor for the scope of:

a) sound-absorbing screens in the area of Aleja Wojska Polskiego 122 A, B, C, D;

b) sound-absorbing screens on the section from Olsztyńska Street to Wesoła Street,

c) collisions with the DN 1000 mm sanitary sewer in the area of the junction at Legionów Street (WD1),

d) elimination of collision with DN 1000 waterbridge in the area of the footbridge at Okrzei Street (K5) and collision with DN 250 waterworks in the area of the footbridge at Stroma Street (K3),

e) illumination of footbridges and a semi-tunnel screen on the flyover over Aleja Pokoju (WD4),

f) all collisions identified during implementation and not disclosed in the design documentation;

1.4. Cooperation with the Contracting Authority in the scope of settlement and monitoring of the project towards the Managing Authority of the Operational Programme Infrastructure and Environment for 2014-2020 (OPIE 2014-2020) and all other co-financing institutions that may appear during the term of the Contract.
