Description:
The contract involves delivering a neurosurgical navigation system to a specified hospital, including installation and training for personnel, with compliance requirements for participation outlined in the specifications.

1. The subject of the contract is the delivery of a neurosurgical navigation system to the Ordering Party's headquarters in accordance with the description and requirements contained in Annex No. 1 to the Specification.
2. Offers lacking the full scope of the subject matter of the order will be rejected.
3. The remaining conditions of the order are specified in the draft contract, which constitutes Annex No. 3 to the Specification.
REQUIRED DEADLINE AND CONDITIONS FOR THE EXECUTION OF THE ORDER
1. Deadline for delivery of the equipment: by 4 weeks from the date of signing the Contract.
2. Delivery, installation, and commissioning of the equipment at the Specialist Hospital named after Ludwik Rydygier in Krakow sp. z o.o., 31-826 Krakow, os. Złotej Jesieni 1.
3. The contractor undertakes on the day of delivery of the subject of the contract to conduct training for the medical and technical personnel of the Ordering Party (as described in Annex 1 to the SWZ) at its headquarters – os. Złotej Jesieni 1, Krakow, or to ensure at its own expense such training by a third party. Training will be confirmed by issuing named certificates.
CONDITIONS OF PARTICIPATION IN THE PROCEDURE AND METHOD OF ASSESSING THE FULFILLMENT OF THESE CONDITIONS
Contract can be awarded to Contractors who meet the conditions specified in Article 57 of the Pzp Act and Article 112(2) of the Pzp Act, i.e.:
1) are not excluded
2) meet the conditions of participation in the proceedings regarding:
a) ability to conduct business - The Ordering Party does not establish detailed participation conditions in the Procedure.
b) rights to conduct a specified business or professional activity - The Ordering Party does not establish detailed participation conditions in the Procedure.
c) economic or financial situation - The Ordering Party does not establish detailed participation conditions in the Procedure.
d) technical or professional ability - The Ordering Party does not establish detailed participation conditions in the Procedure.
Contractors may participate in the proceedings who are not excluded from the proceedings on the basis of Article 108 of the Pzp Act and Article 109(1)(1) and (4) of the Pzp Act, and are not excluded from the proceedings on the basis of Article 7(1) of the act of April 13, 2022, on special solutions to counteract support for aggression against Ukraine and serving the protection of national security (Dz.U. of 2024 item 507), and are not subject to prohibition on granting or further execution of any public contracts under Article 5k(1) of Council Regulation (EU) No. 833/2014 of July 31, 2014, concerning restrictive measures in connection with actions by Russia destabilizing the situation in Ukraine (Dz. Urz. UE L 229 of July 31, 2014, p. 1, as amended).
In proving fulfillment of the conditions referred to in Article 57 of the Pzp Act, the Contractor submits:
a) a declaration of fulfillment of the conditions for participation in the proceedings - signed by the appropriate person(s) authorized to represent the Contractor. The appropriate declaration is submitted by the Contractor in the form of a single document, which constitutes Annex No. 4 to the Specification (form JEDZ);
In confirming the absence of grounds for exclusion from the Procedure in the circumstances referred to in Article 108 of the Pzp Act and Article 109(1)(1) and (4) of the Pzp Act and Article 7(1) of the act of April 13, 2022, on special solutions to counteract support for aggression against Ukraine and serving the protection of national security (Dz.U. of 2024 item 507) and Article 5k(1) of Council Regulation (EU) No. 833/2014 of July 31, 2014, concerning restrictive measures in connection with actions by Russia destabilizing the situation in Ukraine (Dz. Urz. UE L 229 of July 31, 2014, p. 1, as amended), the Contractor submits:
a) a declaration of lack of grounds for exclusion from the proceedings - filled out and signed appropriately by the authorized person(s) to represent the Contractor. The appropriate declaration is submitted by the Contractor in the form of a single document, which constitutes Annex No. 4 to the Specification (form JEDZ),
b) a declaration that the Contractor is not excluded from the proceedings based on Article 7(1) of the act of April 13, 2022, on special solutions to counteract support for aggression against Ukraine and serving the protection of national security (Dz.U. of 2024 item 507) and is not subject to prohibition on granting or further execution of any public contracts under Article 5k(1) of Council Regulation (EU) No. 833/2014 of July 31, 2014, concerning restrictive measures in connection with actions by Russia destabilizing the situation in Ukraine (Dz. Urz. UE L 229 of July 31, 2014, p. 1, as amended) - filled out and signed appropriately by the authorized person(s) to represent the Contractor - Annex No. 2 to the Specification.
Co-financing of the order under the Project: “Modernization and expansion of the diagnostic infrastructure, associated treatment, pharmacotherapy and pharmaceutical care for oncological patients at the Specialist Hospital named after Ludwik Rydygier in Krakow” as part of the National Recovery and Resilience Plan. Component D “Efficiency, accessibility, and quality of the health care system”.
NOTE: The Ordering Party reserves the right to annul the procurement procedure in the case of non-allocation of funds that the Ordering Party intended to allocate for financing the order (Article 257 of the Pzp Act).

NEUROSURGICAL NAVIGATION SYSTEM.

PROOF OF SUBJECT MATTER
1. The Ordering Party requires submission with the offer:
- CE Certificate or Declaration of Conformity,
- Written declaration from the manufacturer confirming the application of an equivalent environmental management system compliant with ISO 14001 standard and/or ISO 14001 certificate issued to the authorized representative in the EU.
2. According to Article 107(2) of the Pzp Act, the Ordering Party informs that if the contractor does not submit the required evidence or submitted evidence is incomplete, the Ordering Party will request their submission or supplementation within a specified time.
3. The Ordering Party also accepts certificates issued by other equivalent conformity assessment bodies.
4. The Ordering Party accepts appropriate required subject matter evidence other than those referred to in Articles 105(1) and (3) of the Pzp Act, in particular technical documentation from the manufacturer, in case a given contractor does not have access to the certificates or research reports referred to in Articles 105(1) and (3) of the Pzp Act or the possibility of obtaining them in due time, provided that the lack of access is not attributable to that contractor, and on the condition that the given contractor proves that the works, supplies or services performed meet the requirements, features or criteria specified in the description of the subject matter of the order or the evaluation criteria, or requirements related to the execution of the order.
PROOF OF ENTITY
The Ordering Party will request submission of:
a) information from the National Criminal Register in the scope specified in Article 108(1)(1), (2) and (4) of the Act, issued no earlier than 6 months before submission;
b) copy or information from the National Court Register or from the Central Register and Information on Business Activity, prepared no earlier than 3 months before its submission if separate provisions require entry in the register or records, to confirm the lack of grounds for exclusion based on Article 109(1)(4) of the Act;
c) certificate from the relevant head of the tax office confirming that the contractor is not in arrears with tax and charges, regarding Article 109(1)(1) of the Act, issued no earlier than 3 months before its submission, and in case of any tax or charges arrears along with the certificate, the Ordering Party requires submission of documents confirming that respectively before the deadline for submitting applications for participation in the proceedings or before the deadline for submitting offers, the contractor made payments due for taxes or charges along with interest or penalties or concluded a binding agreement regarding the repayment of those debts;
d) certificate or other document from the relevant regional unit of the Social Insurance Institution or the appropriate regional branch or the relevant field unit of the Agricultural Social Insurance Fund confirming that the contractor is not in arrears with social and health insurance contributions, regarding Article 109(1)(1) of the Act, issued no earlier than 3 months before its submission, and in case of any contributions arrears along with the certificate or other document the Ordering Party requires submission of documents confirming that respectively before the deadline for submitting applications for participation in the proceedings or before the deadline for submitting offers, the contractor made payments due for contributions along with interest or penalties or concluded a binding agreement regarding the repayment of those debts;
e) declaration from the contractor on the currency of the information contained in the declaration referred to in Article 125(1) of the Pzp Act, concerning the grounds for exclusion from the proceedings indicated by the Ordering Party, referred to in: Article 108(1)(3) of the Pzp Act, Article 108(1)(4) of the Pzp Act, regarding the order not to apply for public procurement as a preventive measure, Article 108(1)(5) of the Pzp Act, concerning the conclusion of an agreement with other contractors aimed at disrupting competition, Article 108(1)(6) of the Pzp Act, the relevant declaration should be submitted on the form, the template of which constitutes Annex No. 5 to the SWZ.
f) declaration from the contractor, in the scope of Article 108(1)(5) of the Pzp Act, on the lack of membership in the same capital group within the meaning of the Act of February 16, 2007 on competition and consumer protection (Dz. U. of 2024 item 1616), with another contractor who submitted a separate offer, or a declaration of belonging to the same capital group along with documents or information confirming the preparation of the offer, partial offer, or request for admission to participate in the proceedings regardless of another contractor from the same capital group - the template of the declaration constitutes Annex No. 6 to the Specification.
