1. The subject of the contract is the design, delivery, and installation of photovoltaic systems along with energy storage for the Municipal Transport Authority in Zawiercie as part of the project titled: “Development of decentralized energy based on renewable energy sources for public utility buildings in the Municipality of Zawiercie 3”.
• Inventory of the electrical installation to the extent necessary for design;
• Application for necessary agreements, decisions (if necessary), including: requesting connection conditions for the purpose of connecting the generator source, building permits, or notifications;
• Development of project documentation and its agreement with the Ordering Party;
• Modernization and equipping the main distribution board of the building necessary for the safe operation of the photovoltaic installation;
• Construction of the photovoltaic installation on the building and land with a total power of at least 300.00 kWp;
• Obtaining all administrative and legal permits;
• Installation of supporting structures for the PV modules;
• Installation of PV modules on supporting structures;
• Installation of inverter(s);
• Installation of energy storage with an integrated energy management system;
• Laying cabling on the DC and AC side using appropriate devices;
• Connecting the PV installation to the main electrical distribution board for the facility;
• Protection of the photovoltaic installation against lightning;
• Renovation of the roof by laying an additional layer of thermal-welded roofing, with modified SBS top cover, consisting of polyester non-woven fabric at least 5.6 mm thick with a minimum flexibility of -20ºC on an area corresponding to the installation area.
• Making seals and repairs post-installation;
• Conducting tests to check the proper functioning of the system, including the apparatus;
• Starting and adjusting the system;
• Marking the distribution board, cable connection informing about the PV installation and electric energy storage (if applicable);
• Electric measurements;
• Training for the Ordering Party and User;
• Reporting the installation to the energy company and PSP Zawiercie;
• Development of as-built documentation.
3. The equipment delivered must be unused and brand new, produced not earlier than in 2025, coming from serial production considering the configuration options provided by the manufacturer for the offered equipment model and originating from an official distribution channel to the European market. The Ordering Party does not allow equipment that is a prototype, and the used technology and its individual components should have been verified in practical use.
4. A detailed description of the subject of the contract and the method of execution of parts of the order can be found in the Functional-Utility Program (PFU), which is attached to the Terms of Reference (SWZ).
5. The Ordering Party informs that, according to the provisions of the Draft Terms of the Agreement, it will require the Contractor selected in the procedure, during the execution time of the contract, to establish insurance protection (according to the rules specified in the Draft Terms of the Agreement) and to provide a performance bond as specified in the content of the SWZ.
6. The Ordering Party requires the Contractor to provide:
a) product warranty for DC/AC inverters - min. 10 years,
b) product warranty for energy storage - min. 8 years,
c) warranty for the remaining equipment of the installation minimum 8 years.
7. Time for fault removal - up to 7 working days from the moment of their notification during working days from 7:00 to 15:00.
8. Response time to service request - up to 24 hours from the moment of notification during working days from 7:00 to 15:00 on the principles resulting from the Agreement.

9. Where a trademark (brand), patent, origin, source, or specific process characterizing the products or services provided by a specific Contractor has been indicated in the SWZ, the PFU, or other ordering documents, the Ordering Party, according to art. 99 sec. 5 of the Act, allows for the submission of an equivalent bid or, according to art. 101 sec. 4 of the Act, offering “equivalent” solutions in relation to those indicated in the Description of the subject of the order, provided that they guarantee the achievement of technical parameters not worse than those assumed in the SWZ, including the PFU.
10. According to art. 101 sec. 5 of the Pzp Act, the Contractor referencing equivalent solutions to those described by the Ordering Party (within the scope of standards, technical assessments, technical specifications, and reference technical systems mentioned in art. 101 sec. 1 item 2 and sec. 3 of the Pzp Act) must prove in the submission, especially by means of evidence referred to in art. 104-107 of the Pzp Act, that the proposed solutions meet the requirements specified in the description of the subject of the order to an equivalent degree.
11. The Ordering Party requires that with the offer, the relevant evidence is submitted, i.e., the specifications of the offered devices, confirming that the devices meet the requirements contained in the description of the subject of the contract and the minimum technical parameters indicated by the Ordering Party, according to attachment no. .... to the SWZ. The Ordering Party anticipates the supplementation of relevant evidence when the Contractor has not submitted it or the submitted relevant evidence is incomplete.
12. Given the requirements contained in art. 101 sec. 1 of the Pzp Act concerning availability for all users, especially persons with disabilities, the Ordering Party requires, where mandated by the subject of the order, the installation to be carried out in a manner ensuring the performance of maintenance activities for persons with disabilities.
