1. The subject of the contract is the performance of a service related to repair, inspection

and maintenance of mechanical ventilation units, air conditioning devices and installations and 130 pieces of portable air conditioners located in buildings administered by the 41st School Aviation Base in Dęblin.

2. The proceedings are divided into two (2) independent tasks:

a) TASK I – the subject of the contract is the performance of a service related to the repair, inspection and maintenance of mechanical ventilation units, devices and air conditioning installations located in buildings administered by the 41st School Aviation Base in Dęblin.

b) TASK II – the subject of the contract is the performance of a service related to the inspection

and maintenance of 130 pieces of portable air conditioners and readiness to repair possible failures during the term of the contract.

1. TASK I – the subject of the contract is the performance of a service related to the repair, inspection and maintenance of mechanical ventilation units, devices and air conditioning installations located in buildings administered by the 41st School Aviation Base in Dęblin.

2. A detailed description of the subject of the contract is specified in this SWZ and:

- Annex No 1 to SWZ i.e. the offer form;

- Appendix No. 2a to the SWZ, i.e. a detailed description of the subject of the contract for task I;

- Appendix No. 2b to the SWZ – draft provisions of the contract for task I;

3. Requirement of employment under an employment contract: Acting in accordance with Article 95(1) of the Public Procurement Law, the Contracting Authority requires employment under an employment contract throughout the entire period of performance of the subject of the contract by the Contractor or Subcontractor of persons performing the following activities during the performance of the contract, the performance of which consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – Labour Code:

The Ordering Party requires the Contractor or Subcontractor to employ on the basis of an employment relationship persons performing activities directly related to maintenance inspections, repairs and emergency repairs of mechanical ventilation and air conditioning installations. The coordinator who is the person supervising the implementation of the contract in question does not have to be employed on the basis of

4. The Contractor does not require the Contractor's personal performance of key parts of the order.

5. The contracting authority shall provide for the possibility of exercising the right of option specified in Article 441 of the PPL:

5.1. As part of the optional order, emergency repairs will be carried out, going beyond the scope specified in §1 of the draft contract and the purchase of parts necessary to remove failures up to the financial limit allocated for this purpose.

5.2. The execution of the order covered by the option right is a right and not an obligation of the Ordering Party. The contracting authority may not exercise the right of option, in particular:

in the event of failure to obtain funds for this purpose, and the Contractor is not entitled to

No claims on this account.

5.3. The Ordering Party may exercise the option right repeatedly, until the maximum amount is exhausted, i.e. PLN 229,813.20 gross, including:

- amount allocated for parts and materials for repairing failures: PLN 199,813.20 gross;

- the amount allocated for emergency repairs, i.e. man-hours: PLN 30,000.00 gross.

The Purchaser may exercise the right of option during the term of the contract.

The Ordering Party informs that if:

- the allocated financial resources for parts and materials for repairing failures will not be sufficient and will exceed the amount allocated for it, i.e. the gross amount of PLN 199,813.20 - the Ordering Party will increase this amount, thus reducing the gross amount allocated for emergency repairs (man-hours), i.e. PLN 30,000.00;

- the allocated funds for emergency repairs (man-hours) will not be sufficient and will exceed the gross amount allocated to it PLN 30,000.00 - the Ordering Party will increase this amount, thus reducing the gross amount for parts and materials for repairing failures in the amount of PLN 199,813.20

The total remuneration covered by the option right may not exceed PLN 229,813.20 gross.

6. The contracting authority, guided by knowledge and experience from the proceedings,

from previous years and the principle of economy in spending public funds determines the maximum rate of man-hour for the amount of:

6.1. TASK I - PLN 300.00 gross. The rate was determined on the basis of market research and two bids obtained. The offer of the Contractor who offers the price of 1 rbh of emergency repairs carried out under the option right above PLN 300.00 gross will be rejected from the proceedings in question (within the scope of task I) pursuant to Article 226 paragraph 1 point 5) of the Act of 11 September 2019 Public Procurement Law (Journal of Laws of 2022, items 1710, 1812, 1933, 2185).

2. A detailed description of the subject of the contract shall be specified in the SWZ and

- Annex No 1 to SWZ i.e. the offer form;

- Appendix No. 3a to the SWZ, i.e. a detailed description of the subject of the contract for task II;

- Annex No. 3b to the SWZ – draft provisions of the contract for task II;

3. Requirement of employment under a contract of employment: The contracting authority does not specify the requirement of employment on the basis of an employment contract.

4. The contracting authority, guided by the knowledge and experience of proceedings from previous years and the principle of economy in spending public funds, determines the maximum man-hour rate at the following amount: PLN 400.00 gross. The rate was determined on the basis of market research and two bids obtained. The offer of the Contractor who offers a price of 1 rbh of emergency repairs above PLN 400.00 gross will be rejected from the proceedings in question (within the scope of task I) pursuant to Article 226 paragraph 1 point 5) of the Act of 11 September 2019 Public Procurement Law (Journal of Laws of 2022, items 1710, 1812, 1933, 2185).
