The subject of the contract is the delivery of current, voltage and combined transformers constituting the equipment of the Ordering Station, along with the provision of additional services.
The subject of the contract has been divided into 4 parts.

Part 1 - Delivery of transformers for the task entitled: "Modernization of the 220/110 kV Leszno Gronowo substation - stage II1. Part 1 - Delivery of transformers for the task entitled: "Modernization of the 220/110 kV Leszno Gronowo substation - stage II

3. The contracting authority rejects the bid pursuant to Article 393(1)(4) of the Act (of 11 September 2019, Public Procurement Law (Journal of Laws of 2023, item 1605), hereinafter referred to as the "PPL Act or Act", in which the participation of products, including software used in the equipment of telecommunications networks originating in the Member States of the European Union, countries with which the European Union has concluded agreements on equal treatment of entrepreneurs, or countries to which the provisions of Directive 2014/25/EU apply by virtue of a Council decision shall not exceed 50%.
4. Every time, in all cases where the contracting person describes the subject of the contract by reference to the standards, technical assessments, technical specifications and technical reference systems referred to in Article 101 (1) (2) and (3) of the Contracting Act permits solutions equivalent to the described if they allow to obtain characteristics or parameters no worse than those recalled. The above means that the contractor may apply the solutions described by the contracting authority “or equivalent”.

Pursuant to Article 101(5) of the Act, the Contractor who refers to solutions equivalent to those described by the Contracting Authority is obliged to demonstrate that the supplies offered by it meet the requirements specified by the Contracting Authority, provided that the Contractor proves in the tender, in particular for

6. regards: section II.2.7) Announcements. Deadline for the contract: no longer than until 25.09.2026, from the date of conclusion of the Agreement, taking into account the intermediate dates indicated in Table 3 in point 3.5 OPZ (cz. II. SWZ). Due to the fact that the order in question is an investor supply of transformers
for the task entitled "Modernization of the 220/110 kV Leszno Gronowo substation – stage II", thus includes the delivery included in the schedule of construction works for the task "Modernization of the 220/110 kV Leszno Gronowo substation – stage II", therefore it must be completed within a specified period. The Contracting Authority explains that in the public procurement procedure in question it is not possible to set a deadline in days, weeks, months or years in accordance with Article 436(1) of the Public Procurement Law. At the same time, the Contracting Authority informs that the starting date indicated in section II.2.7) of the Announcement: 01.02.2024. Due to the parameters of this section, it is the estimated date of commencement of the contract.

The contracting authority shall reject the bid pursuant to Article 393(1)(4) of the PPL, in which the participation of products, including software used in the equipment of telecommunications networks originating in the Member States of the European Union, countries with which the European Union has concluded agreements on equal treatment of entrepreneurs, or countries to which the provisions of Directive 2014/25/EU apply pursuant to the Council decision, does not exceed 50%.
