1. The subject of the contract is the Management and supervision of the implementation of the investment entitled: "Construction of the bypass of Nowy Korczyn.

2. The contract covers the provision of services related to the investor's supervision over the performance of the contract concluded as a result of a separate procedure for construction works, hereinafter referred to as the "Contract" or "Task" entitled: "Construction of the Nowy Korczyn bypass".

3. The detailed scope of the contract, the method of its execution and the method of payment are contained in the Description of the Subject of the Contract (OPZ), also known as the Detailed Technical Specification (SST), constituting Appendix No. 7 to the Terms of Reference.

1. The subject of the contract is the Management and supervision of the implementation of the investment entitled: "Construction of the bypass of Nowy Korczyn.

2. The contract covers the provision of services related to the investor's supervision over the performance of the contract concluded as a result of a separate procedure for construction works, hereinafter referred to as the "Contract" or "Task" entitled: "Construction of the Nowy Korczyn bypass".

3. The scope of the contract includes in particular:

(1) managing and coordinating the construction of the construction;

2) verification of project documentation;

3) fulfilling reporting obligations, including those resulting from EU procedures, and cooperating in this respect with the services of the ŚZDW and the managing authority of the European Regional Development Fund (in the event that the Contracting Authority obtains funding from the European Union budget);

4) providing investor's supervision services over the Contract.

4. The contractor must ensure supervision under the contract in accordance with Polish law, in particular the Construction Law and the Public Procurement Law.

5. The contracting authority requires that the contract be performed by a team of persons meeting the requirements specified in the procurement documents, including the conditions contained in the construction law, and in particular with the provisions on independent technical functions in construction.

6. The Contract Engineer who is a member of the team referred to in paragraph 5 will be a representative of the Contracting Authority and will act within the scope of duties specified in the Terms of Reference, the Detailed Technical Specification and resulting from the current provisions of the Construction Law, the Civil Code, the Public Procurement Law, legal acts regulating the disbursement from EU Funds and applicable technical standards. Within the scope of management and supervision to be provided under this contract, the Contractor is to ensure smooth implementation of the Contract, not exceeding the project budget, timely acceptance of works along with obtaining an occupancy permit and proper future functioning and service of works by the Contracting Authority. The services to be provided under this agreement are management, supervision and verification of project documentation and control of the Contract in accordance with the Contract Conditions. These tasks also include administration and coordination of all activities related to the Project, starting from the pre-construction stage, through the stage of carrying out works, to the warranty period and settlement of the Contract, including supervision over the works in accordance with the Terms of Reference and the applicable Polish construction law (as a team of investor's supervision inspectors).
