Investor supervision and financial and material settlement - the function of the Engineer in the implementation of the zam.pn. "Counteracting the socio-economic effects of Covid-19 through the extension of the provincial road No. 833"

1. The subject of the order is:

Investor supervision and financial and material settlement - the function of the Engineer in the implementation of the order entitled "Counteracting the socio-economic effects of Covid-19 through the extension of the provincial road No. 833 from km 12+980 to m. Kraśnik (km approx. 18+970)"

2. The scope of supervised works includes:

The subject of the investment is the extension of the provincial road No. 833 Chodel – Kraśnik section 1 from km 12+980 to km 17+820 with the construction of a bicycle path to the city. Kraśnik (km approx. 18+970) along with the construction of engineering facilities, retaining walls securing the road embankment, retention and infiltration tank and protection or extension of foreign devices interfering with the road under construction and engineering facilities.

Design documentation is tailored to the needs of all users including ensuring accessibility for people with disabilities.

1. Responsibilities of the Engineer:

1) Stage – the first stage of the implementation of construction works, including supervision over the Investment in accordance with the Construction Law, the Contract with the General Contractor and the management of the Investment, preparation of documentation for material and financial settlements as well as verification, analysis and assessment of multi-branch construction documentation (construction projects, executive designs, replacement projects, technical specifications for the execution and acceptance of works).

Stage II means supervision over the completed Investment during the warranty and guarantee period, including comprehensive reviews of the Investment at least 2 times a year (spring and autumn review) and preparation of Reports and Protocols from these reviews and delivery to the Project Manager within 5 days from the date of the review. In the case of finding defects arising during the warranty and guarantee period, giving opinions and approving repair plans, enforcing and supervising (within the meaning of the scope of obligations resulting from stage I) repair works from the General Contractor, protocol confirmation of their removal, as well as participation in the acceptance after warranty and guarantee, and in the case of disclosure of defects during acceptance after warranty and guarantee, until the date of removal of the defects by the General Contractor or a person Third

2) Providing the Engineer's office.

3) Conducting tests and control measurements by an independent Laboratory.

2. The scope of supervised works includes the following industry works: ROAD INDUSTRY, BRIDGE INDUSTRY, SANITARY INDUSTRY, POWER INDUSTRY, TELECOMMUNICATIONS INDUSTRY, CONSTRUCTION INDUSTRY, GREEN INDUSTRY.

3. Pursuant to Article 13 (1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals in connection with the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC, general the Data Protection Regulation (OJ EU L 119, 4.5.2016, p. 1), hereinafter 'GDPR', informs that:

4. The Contracting Authority shall, in accordance with Article 139 (1) of the pzp Act, first examine and evaluate the tenders and then make the subject qualification of the Contractor whose offer has been highest assessed in the absence of grounds for exclusion and fulfilment of the conditions for participation in the proceedings.

6. Pursuant to Article 95(1) of the PPL Act, the Ordering Party shall specify the obligation to employ persons performing the following activities in the scope of the contract on the basis of an employment contract:

- drawing up payment certificates,

- preparation of monthly reports on the Engineer's activities,

- preparation of monthly reports on the implementation of the investment,

- checking the printouts of work measurements,

- preparation of photographic documentation of the progress of works,

- drawing up protocols from construction councils,

- drawing up minutes of technical councils.

7. The Contracting Authority provides for the grounds for exclusion referred to in Article 108(1) of the Act of 11 September 2019. Public Procurement Law (Journal of Laws of 2021, item 1129, as amended) and in the Act of 13 April 2022 (Journal of Laws of 2022, item 835) and in Article 5k of Regulation (EU) 2022/576 amending Regulation (EU) No 833/2014.
