The subject of the contract are services in the field of forest management in accordance with the definition in Article 6(1)(1) of the Act of 28 September 1991 on forests (consolidated text: Journal of Laws of 2022, item 672 – "Act on Forests") including works in the field of forest breeding and protection, fire protection, harvesting and harvesting of wood, to be performed in the Bielsk Forest District in Bielsk Podlaski in 2023.

Quality standards relating to all essential features of the subject of the contract are specified in Annex 3 to the SWZ, which consists of:

No. 3.2.Description of the standard of forestry work technology in the Regional Directorate of State Forests in Białystok adopted by Decision No. 11/2022 of the Regional Director of State Forests of 29 June 2022 on the introduction of the Regional Description of the ForestRy Technology Standard.

Specified Annex No. 3.1. to the SWZ and in Annex No. 3.2. to the SWZ, a detailed description of the standard of technology for performing individual forest works (activities) is the basis for determining the quality requirements relating to the elements constituting the subject of the contract (Annex No. 2 to the SWZ). If the activity described in the above-mentioned annexes is not provided for in the description of the subject of the contract (Annex No. 2 to SWZ), then in this respect the provisions of Annex No. 3.1. to SWZ and in Annex No. 3.2 to SWZ do not apply.

Contractors who are not subject to exclusion from the procurement procedure in the circumstances referred to in Article 108(1) of the Public Procurement Law may participate in the procedure.

Due to the fact that the value of the contract does not exceed the PLN equivalent of EUR 10 000 000 for services, the exclusion condition referred to in Article 108(2) of the Public Procurement Law does not exist in the present proceedings.

Contractors who are not subject to exclusion from the procurement procedure in the circumstances referred to in Article 109(1)(2-5) and (7-10) of the Public Procurement Law may participate in the procedure.

LIST OF STATEMENTS AND MEASURES OF EVIDENCE IN ORDER TO DEMONSTRATE THE ABSENCE OF GROUNDS FOR EXCLUSION FROM THE PROCEEDINGS AND FULFILMENT OF THE CONDITIONS FOR PARTICIPATION IN THE PROCEEDINGS

In order to confirm the absence of grounds for exclusion from the proceedings referred to in points 6.1. - 6.4. and to confirm compliance with the conditions for participation in the proceedings referred to in point 7.1. The Contractor is obliged to submit together with the offer:

(a)a declaration by the Contractor that it is not subject to exclusion and fulfils the conditions for participation in the procedure, submitted on the Form of the European Single Procurement Document ('JAD'), drawn up in accordance with the model standard form set out in Commission Implementing Regulation (EU) 2016/7 of 5 January 2016 establishing a standard form for the European Single Procurement Document (OJ L ..., p. EU L Series 2016 No. 3, p. 16). The JEDZ is evidence confirming the absence of grounds for exclusion and the fulfilment of the conditions for participation in the procedure, as at the date of submission of tenders, temporarily replacing the subjective means of proof required by the Ordering Party.

b) the Contractor's statement on the lack of grounds for exclusion in the scope referred to in Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 – (the template of the Contractor's statement regarding the grounds for exclusion from Article 5k of Regulation 833/2014 constitutes Annex 5 to the SWZ)

In order to confirm the fulfilment of the conditions for participation in the proceedings referred to in point 7.1. SWZ, the Contracting Authority shall, before selecting the most favourable tender, acting on the basis of Article 126 (1) of the PZP, call upon the Contractor, whose offer has been highest assessed, to submit within the time limit not less than 10 days, current at the date of submission of the following measures of evidence:

(b) evidence specifying whether the Contractor indicated in the list of services to confirm the fulfilment of the condition for participation in the procedure for technical or professional capability in the field of experience has been performed or is duly performed,

The evidence referred to above is references or other documents drawn up by the entity to which the services were performed and in the case of recurring or continuous benefits, and if the Contractor for reasons independent of him is unable to obtain these documents — a declaration by the Contractor; in the case of recurring or continuous benefits, references or other documents proving their proper performance should be issued within the last 3 months (back from the date on which the deadline for submission of tenders expires).
