1. The subject of the contract is the supply of electricity to the indicated CZG-12 consumption points listed in Annex 8 to the SWZ in the period from 01.01.2023 to 31.12.2024.

4. The above-mentioned forecasted electricity consumption is indicative and may differ from the amount of energy actually consumed during the term of the contract (fluctuation at the level of +/- 25%). Reducing or increasing the amount of energy consumed does not entail any consequences for the ordering party (recipient), except for the need to pay for the energy actually consumed at the rates specified in the concluded contract.
5. Quality standards: the subject of the contract are the supply of electricity with quality standards specified in accordance with applicable regulations. Quality standards of electricity are described in the Act of 10 April 1997 – Energy Law and the Regulation of the Minister of Economy of 4 May 2007 on detailed conditions for the functioning of the power system (Journal of Laws of 2007 No. 93, item 623, as amended). The rules for shaping tariff calculations and settlements in electricity trading are set out in the Regulation of the Minister of Energy of 6 March 2019 (Journal of Laws of 2019, item 503, as amended).
6. Distribution services will be provided on the basis of separate agreements concluded between the ordering party and the distribution system operator (DSO).

8. The Contractor, based on the power of attorney granted, will be obliged to report on its own behalf and on behalf of the contracting authority (the customer) contracts for the sale of electricity to the competent DSO in accordance with applicable regulations.
9. Note: The Contractor shall notify the collection points only on the basis of the data provided (after the conclusion of the electricity sales contract) by the ordering party or its Proxy to change the seller.
10. In Annex 8 to swz in the change column, it is indicated that the change of the seller will take place once again, i.e. that the ordering party (recipient) has distribution agreements concluded for an indefinite period.
11. In Annex 8 to swz in the column "Recipient (address for sending invoices)" indicates the Recipient and the address to which the invoice should be sent (one collective). Data on issuing and delivering an invoice will be included in the contract for the supply of electricity / annex to the contract.
12. Existing contracts for the supply of electricity will expire or be terminated with effect from the day preceding the planned date of commencement of supply.
13. With regard to all PPE, the ordering party (the customer) has the status of a customer, so he has the right to purchase energy from a seller of his choice / Article 4j paragraph 1 of the Energy Law Act of 10 April 1997.
14. The settlement for the electricity collected will take place on the basis of data on electricity consumption of the Special Purpose Association of Municipalities CZG-12 Długoszyn 80, 69-200 Sulęcin for the dso made available to the contractor by the DSO for a given settlement period. The contracting authority does not allow the issuance of an invoice on the basis of estimated consumption prepared by the contractor – the prohibition does not apply to estimated consumption reported by DSOs.
15. Settlements are to be carried out according to the recipient, the ordering party agrees to issue one common invoice for collection points.
16. For the purposes of settlements for the electricity consumed, the contractor will use (as the starting point) the net unit price. The Ordering Party agrees to use the kWh or MWh unit on invoices.
