Provision of water rescue services in the Sports and Rehabilitation Center of the Medical University of Warsaw

The subject of the agreement is the provision of water rescue services in the Sports and Rehabilitation Center of the Medical University of Warsaw, hereinafter referred to as "CSR" – understood as ensuring the safety of people practicing water sports, bathing and staying at swimming pools (Olympic swimming pool with dimensions of 25 x 50 m – with the possibility of dividing into two basins measuring 25x25m each, warm-up pool with dimensions of 10.5 x 25m), as well as people using saunas and other rooms in swimming pool area, under the conditions specified in the Draft Agreement.

1. The subject of the agreement is the provision of water rescue services in the facility of the Sports and Rehabilitation Centre of the Medical University of Warsaw, hereinafter referred to as "CSR" – understood as ensuring the safety of persons practicing water sports, bathing and staying at swimming pools (Olympic basin with dimensions of 25 x 50 m – with the possibility of dividing into two basins measuring 25x25m each, warm-up pool with dimensions of 10.5 x 25m), as well as persons using saunas and other rooms in the swimming pool zone, under the conditions specified in the Draft Agreement, constituting Annex 6 to the SWZ.

2. Rescue services will be provided simultaneously by a 5-person team of water rescuers, 7 days a week, from Monday to Friday from 06:00 to 22:00 (changes from 6:00 to 14:00 and from 14:00 to 22:00) and on Saturdays and Sundays from 06:00 to 21:00 (changes from 6:00 to 13:30 and from 13:30 to 21:00), excluding holidays, public holidays and technological breaks, for a total period of up to 75 000 hours , subject to paragraph 3.

3. The Contracting Authority reserves the right not to use the subject of the contract in terms of the number of hours and in terms of value, however, not exceeding 10% of the remuneration specified in the Contractor's bid selected in these proceedings.

4. Pursuant to Article 95(1) of the Act, the Contracting Authority requires that lifeguards be employed on the basis of an employment relationship, in a total amount of not less than 11 FTEs. The Contracting Authority allows the Contractor to use persons other than those employed on the basis of the above employment relationship during the performance of the contract, however, these persons will be employed to provide replacement during the holiday period, work on weekends, sick leave or in other random cases.

5. The Contracting Authority also requires the appointment of a Coordinator with at least 3 years of professional experience in the management of water rescue teams in sports or recreational facilities with an indoor pool, responsible in particular for keeping basic documentation and reporting system, including keeping a register of Lifeguards' work and documentation and register of rescue operations.

6. Before concluding the contract, the Contractor shall be obliged at its own expense to conclude a contract or subsequent insurance contracts establishing insurance cover against civil liability in the field of water rescue during the term of the contract, covering any damage that may be caused to the Ordering Party or third parties in connection with the implementation of the provisions of this contract, in the amount of not less than PLN 1,000,000.00 (in words: one million zlotys) for one and all events covered by the third party liability agreement.
