Description:
Delivery and implementation of a mobile system designed for detecting and neutralizing Unmanned Aerial Vehicles, including specific warranty conditions and access requirements for confidential attachments.

DESCRIPTION:
1. The subject of the order includes the delivery and implementation of a mobile system for detecting and neutralizing Unmanned Aerial Vehicles (UAVs).
2. A detailed description of the subject of the order regarding the base vehicle is provided in Attachment No. 2 to the SWZ.
3. A detailed description of the subject of the order regarding the structure and system for detecting and neutralizing Unmanned Aerial Vehicles (UAVs) is provided in Attachment No. 3 to the SWZ.
4. Warranty conditions:
4.1. The minimum required warranty period for mechanical, electrical, and electronic components of the vehicle, on which the structure has been made, is 24 months with no mileage limit.
4.2. The minimum required warranty period for the vehicle's paintwork, on which the structure has been made, is 24 months.
4.3. The required warranty period for the perforation of the vehicle's body elements, on which the structure has been made, is 72 months.
4.4. The minimum required warranty period for the structure and equipment, including the system for detecting and neutralizing Unmanned Aerial Vehicles (UAVs), is 24 months.
4.5. The warranty period will commence from the date of acceptance of the subject of the order.
4.6. Updates for the Command and Control software (hereinafter: “C2 Software”) must occur at least once a quarter.
INFORMATION ON RESTRICTED ACCESS TO PART OF SWZ:
1. Pursuant to Article 133(3) in connection with Article 18(2) of the Public Procurement Law (Pzp), the Ordering Party restricts access to Attachment No. 3 and Attachment No. 4 to the SWZ, due to the need to protect confidential information contained therein.
2. Access to Attachment No. 3 and No. 4 to the SWZ will be provided according to the following principles:
2.1. To gain access to Attachment No. 3 and No. 4 to the SWZ, the Contractor will be required to submit a request using the template provided in Attachment No. 8 to the SWZ.
2.2. The request must be signed with a qualified electronic signature of the person(s) authorized to represent the Contractor.
2.3. The request must include a document that shows the authorization to represent the Contractor (e.g., current excerpt from KRS, power of attorney). Regarding the form of documents confirming authorization, the rules resulting from the Regulation of the Prime Minister dated December 30, 2020, on the way of preparing and transmitting information and technical requirements for electronic documents and means of electronic communication in the procedure for granting public contracts or competitions should be applied.
2.4. The request must include a confidentiality agreement signed by the person(s) authorized to represent the Contractor in accordance with Attachment No. 9 to the SWZ.
2.5. If the request is incomplete or contains errors, the Ordering Party will ask the Contractor to complete it within 3 days from the date of sending the request. Failure to complete or incorrect completion of the request will result in it being left unconsidered.
2.6. The request should be submitted to the email address: a.tarka@um.sosnowiec.pl
2.7. Access to Attachment No. 3 and 4 to the SWZ will occur at the email address indicated in the request. The Ordering Party will send a password-protected file containing Attachment No. 3 and 4 to the SWZ. The password allowing access to Attachment No. 3 and 4 will be sent by SMS to the mobile phone number provided in the request.
2.8. The Ordering Party will not provide Attachment No. 3 and 4 to the SWZ to the Contractor if there is a reason described in Chapter I, Paragraph 18 of the SWZ.
ORDERS REFERRED TO IN ARTICLE 214(1)(8) OF THE PZP ACT:
The Ordering Party does not anticipate granting orders based on Article 214(1)(8) of the Pzp Act.
EXECUTION TERM:
The deadline for the execution of the subject of the order is 8 months from the date of the contract conclusion.
The Contractor will grant an indefinite non-exclusive license for C2 Software.
PROTECTION OF PERSONAL DATA COLLECTED BY THE ORDERING PARTY DURING THE PROCEDURE:
Information about personal data protection is included in Chapter I, Paragraph 17 of the Specification of Contract Terms [hereinafter: SWZ].
BASIS FOR EXCLUSION:
1. Contractors who are not subject to exclusion can apply for the order.
2. The Ordering Party will exclude from the procedure Contractors who are subject to the grounds for exclusion referred to in:
- Article 108(1) of the Pzp Act,
- Article 7(1) of the Act of April 13, 2022, on special solutions for countering support for aggression against Ukraine and for protecting national security,
- Article 5k of Regulation (EU) No 833/2014 of July 31, 2014, concerning restrictive measures in connection with actions by Russia destabilizing the situation in Ukraine (OJ EU L 229 of 31.7.2014, p. 1), hereinafter: Regulation 833/2014, as amended by Regulation (EU) 2025/2033 amending Regulation (EU) No 833/2014 concerning restrictive measures in connection with actions by Russia destabilizing the situation in Ukraine (OJ EU L 111 of 8.4.2022, p. 1).
3. Exclusion occurs for the duration of the circumstances specified in Chapter III, Paragraph 2.3. of the SWZ.
4. In the case of a Contractor excluded on the grounds defined in Chapter III, Paragraph 2.3 - 2.4. SWZ, the Ordering Party rejects the offer of that Contractor.
5. A person or entity subject to exclusion on grounds specified in Chapter III, Paragraph 2.3. of the SWZ, who applies for the awarding of a public contract or participates in a procedure for granting a public contract or competition during the exclusion period, is subject to a financial penalty.

CONDITIONS FOR PARTICIPATION IN THE PROCEDURE:
1. Contractors who:
1.1. are not subject to exclusion,
1.2. meet the conditions for participation in the procedure, as specified, may apply for the order.
2. Based on Article 112 of the Pzp Act, the Ordering Party specifies the conditions for participation in the procedure regarding:
2.1. ability to operate in the economic turnover - the Ordering Party does not set a condition for participation in this regard;
2.2. authorization to conduct specific business or professional activities, as far as resulting from separate regulations - the Ordering Party does not set participation conditions in this regard;
2.3. economic or financial situation - the Ordering Party will consider that a Contractor meets the condition regarding the economic situation if the Contractor demonstrates that it has:
2.3.1. financial resources or credit capacity in the amount of at least PLN 2,500,000.00 (in words: two million five hundred thousand zlotys);
2.3.2. appropriate civil liability insurance related to the subject of the order with a guaranteed sum of no less than: PLN 2,500,000.00 (in words: two million five hundred thousand zlotys). In the case of Contractors jointly applying for the order, the condition regarding the economic situation described in point 1.2.3. can be fulfilled collectively by all Contractors. However, each of the conditions described in points 1.2.3.1. and 1.2.3.2. must be fulfilled in full by at least one of the Contractors jointly applying for the order. The Ordering Party does not allow the aggregation or splitting of amounts between Contractors jointly applying for the order regarding the condition described in points 1.2.3.1. and 1.2.3.2.
2.4. technical or professional capability - the Ordering Party will recognize that a Contractor meets the requirement regarding technical or professional capability if the Contractor demonstrates that it has duly executed one delivery worth at least PLN 2,500,000.00 gross, involving the implementation of a system for detecting and non-kinetic neutralization of Unmanned Aerial Vehicles (UAVs) in the last five years.
INFORMATION ON MATERIAL MEANS OF EVIDENCE:
1. The Ordering Party requires that the Contractor, together with the offer, submits the following material means of evidence:
− Technical specification of the offered subject of the order prepared according to the template provided in Attachment No. 4 to the SWZ.
2. The Ordering Party anticipates supplementing the material means of evidence if the Contractor did not submit them or the submitted material means of evidence are incomplete.
EXPLANATION TO FIELD BT-536-Lot:
The indicated date in this field - 20.01.2025 is purely indicative, and the execution term of the order is 8 months from the date of the contract conclusion. The Contractor will grant an indefinite non-exclusive license for C2 Software.
